HC orders closure of unregistered coaching centres in Jammu | | | Early Times Report
srinagar, Feb 10: The Jammu and Kashmir High Court today extended its directions to the coaching and tuition centres of Jammu Division even as it warned an official committee headed by Divisional Commissioner Kashmir with contempt proceedings if unregistered coaching centres in the Kashmir Valley were not closed down immediately. "The Divisional Commissioner Jammu shall comply with the order dated December 30, 2014 and submit detailed report to the Court before the next date," said a division bench comprising Justice Muzaffar Hussain Attar and Justice Janak Raj Kotwal and directed the registry to serve copy of order to Divisional Commissioner, Jammu forthwith. "A similar committee for Jammu Division shall stand constituted as has been constituted in terms of order dated December 30 and all the directions issued shall be complied with by the committee," the court said. On December 30 last year, the Court had ordered constitution of a three-member committee headed by Divisional Commissioner with Director School Education and Inspector General of Police, as its members. The committee was asked to immediately close down all unregistered tuition and coaching centres wherever functioning in the Kashmir division. The court had also directed the committee to forthwith ensure keeping of police personnel on duty in the areas where the tuition and coaching centres are located and functioning. Besides, it had also directed the panel to ensure video surveillance by installation of CCTVs outside the tuition centres. The DCs were asked to ensure that the tuition and the coaching centres notify and display monthly tuition fee as well as detailed particulars of its faculty members including their qualification and experience. They were also asked to provide free admission upto 10% of its total intake capacity in each class, course for the students who happen to be destitute, orphans or who belong to the families living Below the Poverty Line. The court had also directed the owners of tuition/coaching centres to take necessary steps in maintaining moral values in and around institutions. The coaching and tuition centres functioning in Jammu, court said, shall file undertakings that they comply with 2010 Rules and court directions before the Divisional Commissioner Jammu within ten days time. Meanwhile, the court warned the three-member committee headed by Divisional Commissioner Kashmir, observing that in case its order of closing down the coaching centres was not implemented with, then on next date contempt proceedings will be initiated against the members of panel. "In order to secure the interests of children who are studying in the unregistered coaching centres/tuition centres, we order that owners/authorized persons of these coaching centres/tuition centres shall not operate their bank accounts which stand in their names." The Court, the division bench said, was constrained to pass the directions to ensure that noble service of teaching is not reduced lo mere commercial activity. "The interest of children, who are future of the nation is dearer to all and have to be secured at all cost," the division bench said. The court also directed constitution of a two-member committee comprising two former District and Sessions Judges, Ghulam Mohi-ud-Din Dar and Abdul Wahid, to verify the statement made to the undertaking filed by the coaching centres in compliance to the court orders. |
