HC directs H&ME deptt to take decision regarding issuance of NOC to DRD Nursing College

JAMMU, Feb 24: A single bench of High Court has directed the Health & Medical Education department to take decision regarding issuance of NOC in favour of Data Ranpat Dev College of BSC Nursing Bhaloti within one month.
In this writ petition, the petitioner inter alia seeks a direction to the department of health and Medical Education to issue the Essentiality Certificate/NOC in favour of the petitioner institute for B.Sc Nursing, Post basic B.Sc Nursing, ANM and GNM courses with 60 seats for each course thereby enabling the petitioner institute to apply for permission to the Indian Nursing Council to start the aforesaid courses. The petitioner also seeks a direction to respondent No. 4 to issue the consent letter in favour of the petitioner Institute for starting the B.Sc Nursing, Post basic B.Sc Nursing courses.
When the matter was taken up today, learned counsel for the petitioner submitted that this writ petition be disposed of with a direction to respondent No. 1 to consider the case of the petitioner for issuance of Essentiality Certificate/NOC in favour of the petitioner institute for B.Sc Nursing, Post basic B.Sc Nursing, ANM and GNM courses taking into consideration the fact that the petitioner has already applied in April, 2016, by a speaking order in fixed time limit. On the other hand, counsel for the respondents submitted that suitable action in accordance with law shall be taken. Justice Alok Aradhe disposed off the writ petition with a direction to Commissioner Secretary Health & Medical Education department to take a decision with regard to issuance of Essentiality Certificate/NOC in favour of the petitioner institute for B.Sc Nursing, Post basic B.Sc Nursing, ANM and GNM courses by a speaking order within a period of one month from the date of receipt of a certified copy of the order passed today. Justice Aradhe held that it is made clear that this court has not expressed any opinion on merits of the case.
