Srinagar, May 12: An officer once transferred has no business as to how the post, from where he has been transferred, is filled up by the government, the state High Court has said.
A division bench of the court comprising Acting Chief Justice Ramalingam Sudhakar and Justice Sanjeev Kumar made the observation while dismissing a petition by one Abdul Rashid Shah, working as Forester. Shah was placed as In-charge Range Officer, Veshu Range, Special Forest Division, Kulgam and he had was transferred later and placed as forester, the substantive post held by him.
The court held that the contention of Shah that the order, transferring him, has the effect of demoting him is misconceived. "As rightly held by the Writ Court, the appellant is substantively holding the post of Forester and was only placed as In-cahrge Range Officer, that too, not by the competent authority, i.e.
the Government, but by the Chief Conservator of Forests (Central). That apart, the appellant has been transferred and directed to report to Conservator of Forests, South Circle, obviously, in the same capacity in which he was working in the Veshu Range," the division bench said, adding, "The appellant does not have any vested right to stay as In-charge Range Officer, Veshu Range, and once he is transferred, it is none of his business as to how the post, from where he has been transferred, is filled up by the respondents." |
