SRINAGAR, June 16: Higher ups of a leading religious organization have taken law into their own hands and are stopping a duo of brothers in demarcating their land which they got as a share of their ancestral property.
Irony is that the law enforcing agencies are acting as mute spectators to the whole episode. The brothers have moved from pillar to post with the hope that they would get respite. Although, a judge has given an order in their favour but still then they are not allowed to demarcate their land.
Bashir Ahmad Mir and Abdul Hamid Mir sons of Late Abdul Rehman Mir approached the Court after the concerned revenue authorities failed to demarcate their land. Bashir and Hamid are being continuously harassed by their uncle Mohammad Ramzan Mir who is creating obstacles in the demarcation of the land.
The two brothers along with their uncle had a land measuring eight kanals under survey number 2150/1690/627/1 at lane number 4 in the Iqbalabad locality of the Bemina area. Ramzan without waiting for the formal partition of the property donated his share of three kanals and seven Marlas land to Markazi Ahli Sunnat, Srinagar.
"Our land was grabbed by our uncle and after that he in connivance with the Jamiat Ahli Hadees threatened us of dire consequences if we went ahead with the demarcation process. The Jamiat in the first instance denied having any links with Markazi Ahli Sunnat, but later on they took side of our uncle and since then they are harassing us like anything," said Bashir and Hamid while narrating their tale to Early Times.
On June 6 when the two brothers arrived at their piece of land to demarcate it they were attacked by the 500 member strong contingent of Jamiat. The Jamiat members hurled abuses on the two brothers and scared them if they decided to demarcate their land. The Jamiat members under the guise of Markazi Ahli Sunnat led by Ghulam Mohammad Bhat told the two brothers to be ready to face the music if they went ahead with demarcation of their land.
After failing to get justice from the concerned quarters the two brothers approached the office of Law & Parliamentary Affairs minister. The minister marked the application to Deputy Commissioner, Srinagar who in turn asked the Tehsildar, Shalteng to look into the matter and ensure that the two brothers are allowed to demarcate their land. The concerned Tehsildar has failed to utilize his powers and he did not deem it fit to ask for protection of police so that the plot of land in question is demarcated.
Responding to a complaint filed by the two brothers, Sunil Kumar, Third Additional Munsiff, Srinagar has asked the defendants (Idara Markazi Ahli Sunnat) to stop any construction on the property donated by Ramzan to them. The court has also rejected the claims of the defendants that the land in question is Waqaf property and not owned by Bashir and Hamid. However, it has reserved its comments with regard to the contention that the property is yet to be partitioned.
