Allow applicant to inspect Kathua revenue records: SIC | | | Early Times Report Jammu, Apr 11: The State Information Commission (SIC) has directed the district administration Kathua through Tehsildar Territorial to provide information to an RTI applicant regarding some revenue records. In addition to it the commission has also directed the Tehsildar to allow inspection of records by the RTI applicant. Case detail : As per details available one Munshi Ram S/o Kura Ram R/o Gandyal Keerian, Tehsil & District Kathua moved an application dated 02-11-2013 under J&K Right to Information Act, 2009 before the Tehsildar(T) , Kathua who is also a designated Public Information Officer (PIO) where-under he sought the following information :- "Tatima-Sajara of Khasra no. 128, 129, 130, 154, 155 of Village Gandyal (Keerian) Tehsil and District Kathua." As per the statement of the appellant before SIC , the PIO/Tehsildar (T), Kathua did not provide the information within the statutory period of 30 days and feeling aggrieved of inaction on the part of the PIO preferred 1st appeal dated 06-12-2013 before the 1st Appellate Authority i.e. Deputy Commissioner, Kathua which was dismissed on the flimsy ground of deficiency of certain documents. After that the appellant knocked the doors of the State Information Commission (SIC) by filing 2nd appeal and requested the Commission that PIO/Tehsildar(T), Kathua be directed to furnish the requisite information sought in the RTI application. The SIC's order of April 4th : Taking strong note of the official's inaction the SIC issued the following orders which reads as : "In view of the aforesaid facts, PIO/Tehsildar(T), Kathua is hereby directed to furnish the requisite information to the information seeker within three weeks from the date of receipt of this order under an intimation to the Commission. The appellant may be provided an opportunity to inspect the record in the office of Tehsildar (T), Kathua on a working day and certified copies of the relevant documents, if any, required by the appellant may also be provided to him on payment of requisite fee prescribed under rules. The parties are at liberty to settle the date and time for inspection of record in the office of PIO/Tehsildar(T), Kathua which may be convenient to them" |
