HC holds petitioner entitled to free seat in BDS | Directs BOPEE to pay Rs One lakh as compensation | | Jammu, Apr 11 (JNF): In an LPA filed by BOPEE against the judgment of Writ Court regarding free seat of BDS, a Division Bench of High Court comprising Chief Justice MM Kumar and Justice Muzaffar Hussain Attar dismissed the appeal filed by the BOPEE & Ors with the direction that respondent Sunandani Sharma is entitled for free seat of BDS with compensation Rs 1 lac from the BOPEE. Division Bench after hearing Sr Adv PN Raina with Adv JA Hamal and Adv Meharban Singh for the appellants whereas Deputy AG Neeru Goswami appearing for the state and Adv Abhinav Sharma appearing for the Sunandani Sharma, directed BOPEE to issue necessary notification for grant of admission to Sunandani Sharma within one week and also directed Indra Gandhi Govt Dental College Jammu to admit her from the issuance of notification by the BOPEE. The Court further directed Dental Council of India to arrange for additional classes for and take all necessary steps in accordance with rules, so as to enable her to appear in all examination. It was also clarified that though Sunandani Sharma-writ petitioner/respondent is admitted against the available/vacant, which has become available in the year 2013-14 for making her eligible to appear in the examination she can be permitted to take supplementary examination or examination with the students who may be selected in the session 2014-15 by the BOPEE. Court modified direction to extent and held that writ petitioner is entitled to receive an amount of Rs two lakh from BOPEE is modified and it is provided that petitioner nwould be entitled to receive Rs. one lakh. it was directed private respondent will continue to study and complete the course in the payment seats.
