SPCB drags feet in taking action against defaulters

Jammu, Sept 10: Bizarre it may sound but it is fact that State Pollution Control Board (SPCB) had issued an order for closure of 551 defaulting industrial units for non compliance of Environmental Laws, but out of which 144 closure orders had subsequently been kept in abeyance or were withdrawn by board and the status of subsequent action taken in the remaining 407 cases is not available with the board. Sources in the Board told Early Times that SPCB had issued 551 closure orders in the past few years to the defaulting units for violating Environmental laws and it was seen that 144 closure orders were kept in abeyance or withdrawn and the report of rest of the cases was not available.
"The Board had issued closure order to the units for violating The Air (Prevention & Control of Pollution) Act, 1981 which envisages not to discharge air pollutant(s) in excess of the prescribed standards, furnish information to the SPCB of any accident or unforeseen act or event, allow entry to SPCB to ascertain that provisions of the Act are being complied with, apply for the renewal of "Consent to Operate" before expiry of the validity period and industry to ensure that specified emission sampling procedure is being followed by the SPCB," they said.
They informed that similarly for violating The Hazardous Waste (Management And Handling) Rules, 1989, Amendments 2000 in which is ensure that whether the waste(s) generated covered in Schedule 1 and 2 of the amendment rules, 2000, if covered, apply in the Prescribed Format to obtain an "Authorization" for proper treatment and disposal of hazardous waste(s) and comply with the conditions specified in the authorization, take steps, wherever feasible for reduction, recovery and recycling of wastes, ensure proper collection, reception, treatment, storage and disposal of hazardous wastes. They revealed that against the 20 mandatory meetings required to be held during the period from 2008-09 to 2012-13, the Board had met on three occasions only and no specific advice concerning the prevention and control or abatement of pollution was sent to the state government for taking appropriate action. "The committees constituted in March 2009 by the Board under provisions of pollution control Acts had never convened any meeting during the period 2009-13, thus rendering the constitution of these committees a mere formality," they informed. Moreover the annual report required to be prepared under Pollution Control Acts for submission to the State Government for presentation before Legislature was not prepared by the Board during the period from 2008-09 to 2011-12.
