Court acquits teacher in rape case | | | JAMMU, Oct 20 : Principal Sessions Judge Poonch Jaffer Hussain Beigh today acquitted Wallayat Hussain who is teacher by profession and was facing trial in a case of rape with minor student. According to the prosecution case; during the year 2013-2014 the accused teacher, at about 8 a.m committed rape upon the minor prosecutrix in the store room of the school situated at Dara Dullian and threatened the prosecutrix for disclosing it to anybody where after the accused again after 5/6 days committed rape upon the prosecutrix for 2/3 times as a result of which she conceived and was pregnant. Charge for commission of offences u/s 376 RPC was framed against the accused vide court order dated 11.06.2014. Principal Sessions Judge Poonch Jaffer Hussain Beigh observed that the prosecutrix herself has stated that the accused has not committed rape upon her and the accused is innocent. She has further stated that police persons and the peasants forced her to state against the accused when she was brought before the court for recording her statement u/s 164-A Cr.P.C. When the prosecutrix herself has not stated anything against the accused person, it would be a futile exercise to ask the prosecution to lead further evidence. Accordingly the evidence of the prosecution is closed. Court further observed that there is no incriminating circumstance to be put to the accused u/s 342 CrPC. When the prosecutrix herself has not stated anything against the accused person but has denied that the accused has committed rape upon her and has also stated that the accused is innocent, the result is that the challan is dismissed and the accused is acquitted.JNF |
