SIC issues show cause notice to CEO Doda, likely to impose penalty | | | Early Times Report JAMMU, Oct 20: Chief Education Officer (CEO) Doda has been served show cause notice by the State Information Commission (SIC) as the CEO failed to provide information under Right to Information Act (RTI) Act to an information seeker from Bathindi in Jammu. As per documents available with Early Times, one Parveez Bakhat Malik, resident of Mecca Hill in Bhatindi area of Jammu city moved an application on February 18, 2014 before the PIO, School Education Department, Civil Secretariat, Jammu under Jammu & Kashmir Right to Information Act, 2009 where under he had sought information about the permission granted by the competent authority to a private school located at Bhaderwah. Civil Secretariat authorities forwarded the RTI application to Director School Education Jammu. According to the applicant, he had sought details about the permission granted by the Competent Authority to the School Holly Hocks at Mohalla Saraffa in Bhaderwah Tehsil of District Doda. He had further demanded copy of the rent deed by the owners of building including premises land with the proprietor of School Holly Hocks. He further wanted to know whether any technical verification had been issued by the Competent Authority, in case the building was fit for accommodation, for school with regard to the condition of building at present. PIO/Joint Director, Directorate of School Education, Jammu forwarded the application of the information seeker to Chief Education Officer (CEO) Doda vide office No. DSEJ/Pvt./RTI/5039-40 dated 26-03-2014 with direction to provide information to the information seeker under intimation to the office of Directorate of School Education Jammu. Feeling aggrieved of inaction on the part of CEO, Doda who is also the PIO under RTI Act, the information seeker preferred first appeal dated 26.04.2014 before the First Appellate Authority/ Director, School Education, Jammu. First Appellate Authority/Director, School Education, Jammu vide No. DSEJ/RTI/1748-51 dated 02.05.2014 directed the PIO/CEO, Doda to file counter statement and relevant documents besides to attend the office on 08.05.2014. During the course of proceedings, the appellant alleged that the First Appellate Authority/ Director, School Education, Jammu did not adjudicate and dispose off the first appeal and as such feeling aggrieved of denial of information on the part of PIO/CEO, Doda as well as First Appellate Authority/ Director, School Education, Jammu, the applicant approached office of Information Commission. Appellant filed second appeal dated 01-07-2014 before State Information Commission (SIC). After receiving the second appeal, the matter was listed for hearing on 24.07.2014, 22.08.2014 and 13.10.2014. On 13.10.2014 both the parties were present. The PIO/CEO, Doda submitted a set of information to the appellant and appellant after going through its contents alleged that it is incomplete and not legible. He requested the Commission that CEO Doda be directed to furnish the revised information which may be legible, complete and correct as per office record. SIC issued an order in which it directed CEO Doda to furnish the revised information to the information seeker as available in the office record and complete in all respects within seven days from the date of pronouncement of this order.PIO/CEO, Doda further directed to send information to the information seeker under a registered cover at his residential address. Information commission further CEO Doda to show cause why penalty under section 17 of the J&K Right to Information Act, 2009 may not be imposed upon him for his failure to furnish information to the information seeker within the statutory period as prescribed under J&K Right to Information Act, 2009 within two weeks from the date of receipt of this order. |
