JAMMU, Dec 15:The crime branch (CB) of state police has produced challan against two persons, including an advocate, for allegedly forging the registration of a Marriage Agreement. The challan was produced under sections 420, 193, 465, 466, 468, 471 and 120-B of RPC against advocate Showkat Hussain Khan, son of Abdul Rashid Khan of Mohalla Khawaja, Gilgit in Sopore, Kashmir, and Haq Nawaz Hussain, son of Abdul Rahim Mir of Zerwa Bunjwa, Kishtwar. Showkat practices in Saddar Court, Kashmir. The case was registered on the high court directive in a petition titled Haq Nawaz V/s State of J&K and others wherein directions were given to CB (Jammu) SSP to register a case against the petitioner and others who were found involved in the preparation of forged registration endorsement on the 'Marriage Agreement'. Petitioner Haq Nawaz had approached the high court for seeking directions for the production of Ambika Thakur alias Asia in the high court for handing her over to him, urging that he had contracted marriage with her and that she was in illegal detention of one Sunil Kumar, son of Bansi Lal Sharma of Hatta, Kishtwar. The Marriage Deed produced by him in support of his claim was found forged because the judicial officer by the name of K S Sethi indicated to have registered the marriage document was reported as non-existent as no such magistrate existed in the Jammu and Kashmir Judicial Services. When the show cause notice was issued to him, Haq Nawaz filed the response in the court, stating therein that he and Ambika Thakur had gone to Saddar Courts, Srinagar, for execution and attestation of documents where they prepared all the documents. He stated that they did not know that documents had not been registered by the competent court. He stated that it was the Munsiff Magam who had registered the Marriage Agreement. During the course of investigation, the marriage agreement and other relevant documents were seized which revealed that the documents were executed before K S Sethi, Munsiff Sub-Registrar, Srinagar, on November 26, 2011. On verification, it came to surface that the marriage agreement was neither attested nor registered in the court of Munsiff, Magam, or in the court of Sub-Registrar, Srinagar. During investigation, it was established that advocate Showkat had purchased the stamp papers from two stamp vendors -- Sheikh Parvaiz Ahmed and Bilal Ahmed Wani. The 'Deed of Declaration' executed by Ambika Thakur alias Asia on November 8, 2011 had been prepared and presented by Showkat for attestation before Notary Mohammad Aslam Wani. During the perusal of the forged Marriage Agreement, it became known that names and signatures of two advocates namely Showkat Hussain Khan and Farooq Ahmed Wani were found on the documents. FSL, Jammu, confirmed the authorship of Showkat on fake and forged marriage agreement. After establishing the offences against the accused, the chargesheet was presented before the court of CJM, Srinagar.
