Court discharges 3, directs Police to re-investigate matter of 'abduction case' 12/15/2014 11:10:56 PM Jammu, Dec 15: Principal Sessions Judge Poonch Jaffer Hussain Beigh discharged three alleged accused namely Jaswant Singh, Manmohan Singh and Gurvinder Singh who were challaned by the police in kindapping case and directed police to investigate the matter again. Prinipal Sessions Judge Poonch observed that incomplete challan has been presented against the accused persons before the Court of District Mobile Magistrate Poonch on 29/4/2014 in FIR No.42/2012 for offence u/Ss 366, 109 RPC against the accused persons for kidnapping the prosecutrix Shabeena Akther. Court observed the Investigating Officer (I/O) during the course of investigation has recorded the statement of the witnesses conversant with the facts and has also got recorded the statement of the witnesses u/s 164-A CrPC and without completion of the investigation and without recovery of the prosecutrix the challan has been produced against the accused or kidnapping of the said prosecutrix. Court said unless and until the complete challan is not produced before the court and till the recovery of the prosecutrix and her statement is not recorded or till it is not established that the prosecutrix is dead or alive and till it is not established by the Investigating Officer that the accused have kidnapped the prosecutrix it is not possible to frame charge against the accused persons without completion of the investigation of the case. PP is directed to get the investigation of the case completed in all respects within a period of three months and accordingly the complete investigation report be produced before the court of law.
