10 yrs RI, fine imposed to 10 accused in Kulgam Jamia-e-Masjid attack case

Jammu, Jun 30: Principal Sessions Judge Kulgan Subash C Gupta today awarded ten years rigorous imprisonment to ten accused namely Razak Parrey alias Ama, Aziz Bhat, Jalil Bhat, Manzor Bhat, Sartaj Bhat, Syed Bhat, Dawod Padder, Showkat Bhat, Bashir Ahmad Bhat and Gani Bhat who were convicted by the court in much publicized Kelam Jamia-e-Masjid attack case in which one Nawaz Ahmad died.
While awarding punishment, Principal Sessions Judge Kulgam Subash C Gupta observed that It is not only the duty of the court, but social and legal obligations are clearly enjoined upon it to impose adequate punishment according to law. Court further observed that accused have faced trial in the instant case for about six years and might have repented for the crime, they have committed "Reformation of a criminal shall be the primary goal of administration of criminal justice, the court observed and said, "Long period of imprisonment will serve many purposes. It serves deterrent to others. It also does justice to the victim, their relations and well wishers."
With these observations, Court held that that ends of justice would be meted out, in case, each of the accused is sentenced to rigorous imprisonment for ten years for commission of offence under section 304 Part-I read with section 149 of RPC and a fine of Rs 5,000/- (Rupees Five thousand) only and for six months for commission of offence u/s 323/RPC read with section 149 of RPC and a fine of Rs. 500/- (Rupees Five hundred) only and in default of payment of fine, in case of offence under section 304 Part-I read with section 149 of RPC , each has to undergo further imprisonment for a period of five months and in case of offence u/s 323/RPC read with section 149 of RPC, each have to undergo imprisonment for one months. Both the sentences shall run concurrently.
Among those who have been convicted yesterday during the hearing included Ab.Razak Parrey s/o Gh.Ahmad alias Ama, Aziz Bhat s/o Qadir, Jalil Bhat s/o Qadir, Manzor Bhat s/o Aziz, Sartaj Bhat s/o Aziz, Syed Bhat s/o Habib, Dawod Padder s/o Mohi-ud-din, Showkat Bhat s/o Majid, Bashir Ahmad Bhat s/o Gani and Gani Bhat s/o Qadir.
