PHE Kathua allots work without inviting tenders

Jammu, June 28: Throwing a government order into bin, the PHE department has allotted works to contractors without inviting tenders reportedly to appease a Cabinet Minister, sources told Early Times on Tuesday.
They said, an order to stall the execution of works departmentally without inviting tenders was passed by the department in 2015.
As per official order in possession of Early Times, directions have been issued by the PHE department to execute the work for realignment of old pipes for improvement of water supply execution work to village Dhalli Hiranagar with the condition that the labour shall be provided by the Sarpanch Panchayat Halqua Dhalli Tehsil Hiranagar so that the public in general may not suffer for want of drinking water in coming season.
The work was allegedly allotted on the recommendations of the cabinet minister under D.O PS/EX_HDCM/2016/26059 dated March 28 of 2016, reads order no PHEK/C/10829-32 dated March 29 of 2016.
Following the recommendations of the minister , the Jammu office of the PHE department through letter No. PHEJ/DB/16891 dated March 29 of 2016 was issued and the matter was endorsed by the top officials under ord,er no. 4450 dated March 29 of 2016.
Official order in possession of Early Times reads that in accordance with the provision contained in the J&K Financial code Vol-I Chapter IX Rule (III) 9-8, Public Works Accounts Code, J&K Procurement Manual and Central Vigilance Commission (CVC) guidelines, all the works required to be executed, should be given wide publicity through print media and e-tenders so as to ascertain the lowest market rates. Subsequently, the works should be allotted to the lowest tender after ascertaining its reasonability/feasibility. In reference to para (200) of the Public Works Account Code, only works of emergent/urgent nature like prevention of flood, de-sitting of drains, canal breaches and flood damages etc. are allowed to be executed departmentally by engaging labour through mates/contractors after fulfilling the codal provisions subject to the approval of the competent authority.
"From the scrutiny of the monthly accounts of the divisions, it has been observed that the officials have not followed the prescribed procedure and have resorted to the practice of execution of work departmentally by drawing the self cheques and advancing huge amount to the subordinate officers of the concerned sub-divisions defying codal provisions. Execution of works departmentally flouting the codal provisions shall be the sole responsibility of the concerned officials.
Meanwhile, a Committee was also constituted vide order no 336 PW (Hyd) of 2015 dated December 9 of 2015 for conducting Physical Verification Contract Management and Audit of the ongoing Water Supply Schemes and Irrigation & Flood Control Works of J&K State.
A top official while talking to Early Times admitted that labour was provided by the said Sarpanch but he had not charged anything from the department.
