HC disposes of PIL seeking recovery of ST arrears from defaulters

Jammu, July 23 : Disposing of a PIL, a high court division bench of first puisine judge Ramalingam Sudhakar and Justice B S Walia today said the state government was permitted to exercise powers under section 25-D of the J&K GST Act, 1961 to announce amnesty scheme for the sales tax (ST) defaulters.
The petitioners had sought direction to the commissioners of sales tax and commercial tax, deputy commissioners of commercial tax recovery, Srinagar, and commercial tax recovery, Jammu, and SSPs of Srinagar and Jammu to recover sales tax and VAT from all the defaulters. The bench observed that in view of the March 2, 2016 order, the government was permitted to exercise powers under section 25-D of the J&K GST Act, 1961 to announce amnesty scheme subject to certain conditions. "That order takes care of the issue raised in this petition. Therefore, this PIL stands closed," the bench said.
