Criminal negligence case likely to be slapped on Dr A K Gupta Hospital

Kathua, Sept 15: A criminal medical negligence case is likely to be slapped on Dr A K Gupta Hospital and Research Centre.
After going through the petition of Parkash Singh, son of Saran Singh of Kamla, making serious allegations against the hospital management, Sub-Judge (Special Mobile Magistrate), Kathua, directed SSP, Kathua, to instruct the concerned police officer to get medical opinion from HoD surgery unit of GMCH, Jammu, whether the allegations put forth by complainant were sufficient for registration of offences against Dr AK Gupta Hospital for criminal medical negligence under the provision of section 202 of CrPC. It was stated that a surgery was done on the complainant by Dr A K Gupta on June 26, 2016 for removal of 6.6 mm calculus (stone) from his left kidney. It was submitted that while the patient remained admitted to the hospital from June 26 to July 10, but the doctor could not stop bleeding from the operated part.
When the doctor failed to handle the case, the doctor discharged him from the hospital. The patient later consulted a doctor at GMCH, who, after diagnosis, found out that his one kidney was damaged due to a cut on its vital part. Moreover a calculus of 4 mm size was seen in the middle calyx, liver was enlarged to 17 mm size 17 mm and shows multiple cysts with largest measuring 30*27 mm in segment 4 and Spleen is mildly enlarged in size whereas left Kidney shows 6.6 mm calculus in upper pole, small 1.2 mm concentration and excretion and moderate to severe Hydroureteronephrosis is seen in right kidney with cortical thinning due to 9.5 mm calculus in lower ureter just above the VJJ. "Inflammatory changes seen in right posterior para-renal space are sufficient to prove that Dr A K Gupta had committed many offences and must be gone to jail, the counsel said.
He submitted that the truth must prevail while checking mal-functioning of Private Medical Clinics and Hospitals which allegedly play with the lives of innocent patients to make huge amount.
The victim's son Sethi Singh alleged that Dr AK Gupta charged a huge amount from the patient but left him in the lurch when he needed him most. The family demanded compensation, registration of FIR against Dr Gupta and proper treatment of the patient. The court has directed police for compliance of court's direction and report before September 30, 2016.
