When will SVC become functional? HC asks Govt
'Furnish list of properties attached under Corruption Act'

srinagar, Dec 20: The High Court has asked the State Government to file a compliance report within six weeks indicating a timeframe for making the State Vigilance Commission (SVC) functional.
The State Chief Secretary has been granted six weeks for compliance report by a division bench of the High Court comprising Justice Virender Singh and Justice Muzaffar Hussain Attar in a case involving charges of exploitation of women in Kashmir.
"..The Chief Secretary shall indicate in the compliance report as to how much period State Government would require for making the State Vigilance Commission (SVC) functional," the Court has said in its order issued today.
Observing that 'it (High Court) is pursuing the matter, in its wisdom, the menace of corruption, if left unchecked, would destroy every democratic institution of the State', the Court has ordered the Government to furnish details of properties attached and their forfeiture ordered since the J&K Prevention of Corruption (Amendment) Act 2006 came into force.
Earlier, Madhav Lal, the chief secretary had filed a report before the Srinagar wing of the High Court stating that the Government of Jammu and Kashmir has enacted SVC Act and a three member Vigilance Commission has to be set up. In his last compliance report filed before the court, the chief secretary had stated that the Government shortly constitutes a committee to examine and recommend further amendments in the J&K Prevention of Corruption Act, so as to make it more stringent.
Now in its order, the High Court has said: "It is hoped and trusted that the Committee will be constituted preferably within tow weeks form today and it will make its recommendations within one month thereafter."
The orders have been passed in a case of Mohammad Amin Beigh who is allegedly involved in extortion and physical exploitation of girls. Currently jailed, he has challenged his detention under Public Safety Act (PSA).
Beigh's alleged involvement came into limelight, after women exploitation scandal surfaced on November 2, 2011. A woman had lodged a compliant of attempt to rape before the police station Kralkhud and a case under FIR number was 40/2011 was registered by police under section 451, 506, 376/511 RPC against Beigh.
It has been alleged that after shifting from Kherwan in Kulgam district of South Kashmir, Beigh started a private security firm--Swello Security Agency and established its office in Rajbagh and Anantnag. Beigh would allegedly provide security and helping staff to various hospitals which included female workers also. It is said in the grounds of detention that Beigh under the garb of his business, hired a good number of poor and needy female workers from various parts of the Valley and put them to various jobs relating to security and assistance in different hospitals including L.D Hospital.
"Since most of these workers come from very humble and poor back ground, you not only exploited them monetarily but physically as well. Not only did you coerce them to have physical relations with you but have also reportedly supplied these girls to others. A group of these workers have already narrated their woeful tale before the police authorities," reveal the grounds of detention.
By virtue of today's order, the High Court has asked the Chief Secretary to explain in its compliance report, steps taken for identification and providing support to the poor girls of the State so as to enable them to live a dignified life.
The Court has said in its order: "…The chief secretary will also provide information as to how much money has been received from the Central Government and how much amount has been allocated by the State Government for the benefit of the poor women of the State of Jammu and Kashmir. It shall also be stated in the compliance report as to how and in which manner the said amount has been spent."
