Accused Army men not handed over despite rejection of bail
15 months later, visually handicapped rape victim awaits justice

KISHTWAR, Dec 20: The family members of the 22 year old visually handicapped girl hailing from remote Patimhala area of Kishtwar District have casted doubt on the integrity of senior police officers of Kishtwar District who have failed to arrest the two Territorial Army Jawans Diya Krishan son of Chuni Lal resident of Suid Dachhan and Sajjad Ahmed Sheikh son of Ghulam Ali Sheikh resident of Palmar Kishtwar posted with 159 TA allegedly involved in raping the victim in broad day light when she was alone at her home.
The bother of the rape victim while talking to the "Early Times" said that he and his family were fighting hard for justice since last over one year, but due to lack of support from Kishtwar police the justice continues to elude them and urged upon the people to raise their voice for justice for his sister who can hardly see. Enthused by the response of entire nation against the rape in Delhi recently, the family of the victim has refreshed hopes of getting justice for their daughter . "I urge the people of India to raise voice for justice in favour of my sister as well" Said brother of rape victim.
While recounting the horror, the victim said that the accused in a well coordinated plan entered her residence on 25-9-2011 at around 5 PM when the whole family had gone to fields. She said that among the four Territorial Army personal who entered inside her residence on that day, one Sajjad Hussain Sheikh Son of Ali Sheikh resident of Satarwagi Palmar in Kishtwar District, an Army personal posted with 159 Territorial Army committed rape on her in presence of her 10 year old niece, while the other accused gave the culprits a cover. She said that another person Daya Krishan of Dachhan Kishtwar terrorized her niece when accuse Sajjad Hussain Sheikh committed rape on her. She said that though initially Sajjad covered his face with cloth, but later he removed the same from his face. The victim who is 80% visually handicapped said that she can recognized accuse Sajjad since he (Sajjad) is a local and often visited her home during search operation launched by the security forces in the area. When family approached the police for registration of an FIR against the culprits under relevant section of rape , police registered the FIR of theft. She said that Kishtwar police only after the lapse of nearly 12 days i.e. on 6-10-2011 registered a rape case against the accused. She said that after registration of delayed FIR No: 279/2011 U/S 454/376/109 RPC , she was taken to hospital for medical examination. She said that police had taken her to court for recording her statement before judge, but was made to make tutored statement. Though Kishtwar police claims that they have approach the commanding officer of the concerned Army battalion for handing over the accused, but they did not receive any response from them even after the lapse of nearly 14 months.
It is pertinent to mention that Session Court Kishtwar in the first week of September dismissed the bail application moved by the two accused.
