| State seeks more time to reply on CMA against Baseer Khan | | | Bashir Assad jammu, Feb 7: The Government has sought more time from the High Court for filing reply to the Complaint Miscellaneous Application (CMA) wherein serious allegations have been levelled against Deputy Commissioner Srinagar, Baseer Ahmad Khan. On the request of Additional Advocate General, Gagan Basotra hearing on this case has been deferred till February 11. Sources said that when the PIL came for hearing before Division Bench comprising Chief Justice, Justice MM Kumar and Justice Hasnain Masoodi senior AAG appearing for the State submitted that due to holidays the directions of the court were not complied with and sought more time for filing reply to the CMA wherein the DB had observed that the Deputy Commissioners of the twin capital cities should be having clean and unblemished service records and had asked the State to respond on the issue by or before February 4. The observations were made on CMA wherein serious allegations have been leveled against senior IAS officer DC Srinagar, Baseer Ahmad Khan. Sources said that looking at the public interest involved in the matter the DB allowed more time and directed the listing of the matter on Monday. Council for petitioners in the PIL, Sheikh Showkat Ahmad submitted that he has also submitted complete records of FIR No-37 of 1987 VOJ which is taken on record. It merits a mention here that the High Court on January 31 had expressed its displeasure over the continuation of Baseer Ahmad Khan as Deputy Commissioner Srinagar despite the fact that the State Government has sought the sanction for his prosecution from the Ministry of Department of Personal and Trainings Government of India in the infamous Gulmarg Land Scam in which Challan has already been presented against former Divisional Commissioner Kashmir and nine top hoteliers of Kashmir in the court of Special Anti -Corruption Judge Srinagar. The Chief Justice of J&K High Court, Justice MM Kumar had received a complaint wherein serious allegations were leveled against DC Srinagar, Baseer Ahmad Khan including his prima-facie involvement in Gulmarg land scam in which the State Government has already forwarded the documents to Government of India for obtaining sanction for prosecuting Khan. The Division Bench had expressed its displeasure and surprise over the posting of Khan as DC Srinagar despite the fact that the State has already requested the Union Government for according sanction for prosecution against him in the infamous Gulmarg land scam. The Division Bench treated the complaint as Civil Miscellaneous Application (CMA) in the Public Interest Litigation (PIL) filed by two social activists of Jammu, Sheikh Mohammad Shafi and SK Bhalla. |
