| From day one of its creation Pakistan has made no secret of her determination to grab the State of Jammu & Kashmir., by any means and at any cost. Arguments, of course all spurious , advanced vary from Kashmir being the Jugular vein( Shah Rug) of Pakistan, to its Muslim majority character . Needless to say that none of these have any basis for the simple reason that the 1947 Act of Indian Independence passed by the British parliament was applicable to only British India, not the native states. In fact, Jammu and Kashmir became an independent entity on 14 th of August, 1947 when Pakistan came into being. Her maiden aggression against Jammu & Kashmir in the name of Jihad packaged as tribal invasion led to the accession of the state with the then Indian dominion., landing of Indian army in Srinagar just in time to put the invaders on the run. Pakistan , however got richly rewarded for her aggression under UN brokered Cease-Fire Agreement which left her in illegal possession of large chunk of the Indian territory. T he agreement silenced the guns but Pakistan persisted with her design through subversion and sabotage through her agents and collaborators within the state and operatives, her national as well as foreigner mercenaries and Jihadis infiltrated from across the borders. Three Indo-Pak wars. Mini- Kargil war and now more than two decades long on-going cross border terrorism have wrought havoc in the Jammu & Kashmir . The policy of" bleeding India through thousand cuts", mandated by Zia Ul Haq who also tagged the 'Kashmir issue' to the Pan Islamic network crystallized into extension of terrorist tentacles to the entire length and breadth of the country. The latest twin explosions in DIlSukh Nagar, Hyderabad illustrate the point. Pakistan agents and collaborators bundled under the nomenclature of "Separatists" play a highly significant role in implementing the Pakistan agenda by providing cover for the cross border terrorism and promoting the myth of "freedom Struggle by Kashmiris" to whom Pakistan was merely providing "moral and diplomatic support". It is another matter that this so called moral and diplomatic support translated into naked , brutal and bestial terror was known to the entire world. All these man-oeuvres by Pakistan, her Pan-Islamist patrons and the Kashmiri "Separatists " were transparently aimed at de -accession of Jammu & Kashmir state from the Union of India. It was therefore the bounden duty of the governments centra l and state to break this unholy and anti-national nexus and cry a stern halt o their subversive activities. It was towards this end that THE UNLAWFUL ACTIVITIES (PREVENTION) ACT, 1967 enacted and vigorously enforced . The residents of Jammu & Kashmir visiting the Pakistan embassy in Delhi , openly or clandestinely were placed under observation and where considered desirable questioned to ascertain the bona fides of the contact. Legal action was initiated in fit cases. These and allied steps made in difficult for Pakistan embassy to pursue her anti India agenda and placed effective curbs on the activities of secessionist elements. And then the Indian state was bitten by a suicide bug .In the name of an elusive and doubtful peace , Pakistan was allowed to openly Hob Nob with Kashmir secessionists , who were invited for consultation and participation in celebration of her National day. Surely during such meetings they did not exchange information about weather. The Indian permissiveness extended to such an absurd extent that the foreign minister of Pakistan consulted Kashmir Separatist leaders in New Delhi before embarking on official rounds of talk with her Indian counterpart . Not to be left behind the Pakistan high commissioner felt bold or reckless enough to invite Separatists in routine without any plusable excuse. The political elite instead of putting their foot down merely bleated their displeasure. The generosity of the Indian government in facilitating visits of individual separatist leaders or party delegation on invitation from Pakistan or otherwise brought the situation to a pass where Umar Farooq and company felt emboldened to openly hob knob with notorious Hafiz Sayed , the internationally designated terrorist and most wanted master mind of 26/11 Mumbai massacre and meet , guess whom, the chief of PAK ISI. Similarly, Yasin Maik the JKLF brand Gandhian was seen in company of the same very Hafiz. All these people were bound to have submitted in writing the purpose of their visit to Pakistan. Did it include meetings with the Hafiz and ISI Chief ? If so let the government of India come clean and face the Indian nation. If not, why was not the individual questioned and the truth found out? Does the Government of India propose to impound their passports or at least bar them from future visits to Pakistan? The Unlawful Activities( Prevention) Act under section (O) defines as "unlawful activity, in relation to an individual or association, means any action taken by such individual or association (whether by committing an act or by words, either spoken or written, or by signs or by visible representation or otherwise. (i) which is intended, or supports any claim, to bring about, on any ground whatsoever, the cession of a part of the territory of India or the secession of a part of the territory of India from the Union, or which incites any individual or group of individuals to bring about such cession or secession; or (ii) which disclaims, questions, disrupts or is intended to disrupt the sovereignty and territorial It goes on to state: (i) "secession of a part of the territory of India from the Union # includes the assertion of any claim to determine whether such part will remain a part of the territory of India . The provisions of the act are specific and unambiguous . The question arises as to why the violation of the law of the land day in and day out was being condoned? And under what authority and whose orders? The seriousness with which the parliament viewed secessionist activities can be gauged from the wording of section 13 which defined offences and prescribes penalties It stated; 1) Who ever (a) takes part in or commits, or (b) advocates, abets, advises or incites the commission of, any unlawful activity, shall be punishable with imprisonment for a term which may extend to seven years, and shall also be liable to fine .It is a matter of legal interpretation whether facilitating contacts and consultation in pursuance of known conspiracy between self professed secessionists from J&K with the Pakistan officials and others committing acts aimed at securing secession of part of Indian territory( state of Jammu & Kashmir) does amount to abetment ? Let the officials concerned also ponder over their conduct. In any case the nation has a right to know why those acting in the name of the Indian state were facilitating the conspiracy between secessionists and Pakistan to cause disintegration of the Indian Republic? |
