Jammu, Feb 25 (JNF): : Presiding Officer Fast Track Court Jammu Sanjeev Gupta has acquitted one Liaqat Ali who was facing trial in an alleged rape case after the prosecutrix turned hostile. While acquitting the accused persons, the court after hearing advocates AR Khan and TM Khan for the accused person and Public Prosecutor appearing for the state, observed that the accused was charged and prosecution was directed to lead the evidence. "It was examined the prosecutrix knows the accused, about 2/3 years back and she along with her aunt was going to house of a Zamindar but on the way, an unknown person bearing mask, forcibly kidnapped her and took her towards forest. She and her aunt raised alarm but no one came on spot and the masked person did wrong thing with her," the court observed. She further stated that Liaqat Ali is son of her aunt and he is not the person who had done wrong with her. On this prosecution has declared hostile the prosecutrix. The court further observed that from the perusal of the evidence, the most material witness in the case and her medical certificate depicting no evidence of a recent intercourse, there is nothing to suggest that accused had committed the offence with which he has been charged. The court further said that the proceedings against the accused are truncated at this stage as the evidence of prosecutrix tendered during the trial would not prove the charge against the accused and dismissed the prosecution case and acquitted the accused from the charges.
