| HC directs Secretary H&UD to appear in person | | Allotment of Hall at Bahu Plaza to brother of Union Health Minister | | et plus report Jammu, Mar 6 (JNF): In a writ petition filed by Sunil Mahajanchallenging the allotment of hall No 209 South Block Bahu Plaza infavour of Sajjad Ahmed Bhat brother of Union Health Minister Ghulam Nabi Azad, on the ground that the approval accorded by Ministerwas Chairman of the JDA for allotment. Justice JP Singh of Jammu & Kashmir High Court Jammu Wingtoday after hearing Adv SS Ahmed appearing for the petitioner whereasAAG HA Siddqui appearing for the state and Adv IH Bhat appearingfor the private respondent, observed that disposing of a batch of writ petitions vide judgment dated June 1, 2009 with the directionsrequiring the state Govt to examine the issue as to the impropriety orillegality of the allotments of shops/halls at Bahu Plaza complexJammu for passing appropriate orders, directions as warranted underlaw after affording reasonable opportunity of hearing to those who maybe prejudicially affected by the order, which Govt may considerpassing in this behalf. Court further observed that judgment of the Court hasattained finality, however, despite taking numerous opportunities toreport compliance of the directions, the needful has not been done. Court took serious note for non-compliance of the Courtdirections seriously, the State Govt is required to show cause as towhy the concerned functionaries of the State Govt who are responsiblefor the non-compliance of the Court directions be not proceeded against and issued notice to Commissioner/Secretary to Govt, Housing &Urban Development Dept to appear along with state Govt explanation fornon-compliance.
