| SIC directs police to provide Information about SPO | | `Information would affect sovereignty of India' | | ET Report JAMMU, July 29: The State Information Commission (SIC) Jammu office has directed the Poonch Police to provide detailed information about the Special Police Officials (SPO's) to an RTI applicant. The Dy SP (Headquarters) Poonch who is also the Public Information Officer (PIO) of the District Police Office, Poonch had earlier denied the information by invoking section 8 of J&K RTI Act 2009 (information would directly affect the integrity and sovereignty of India) . The RTI applicant filed 1st appeal before the Additional SP Poonch who is the First Appellate Authority (FAA) of District Police Office . The FAA upheld the order of the PIO and this prompted the RTI applicant to knock the doors of State Information Commission. The State Information Commissioner Dr SK Sharma while passing the order in this case clearly directed the DySP (Hqs) Poonch to provide the information to the RTI applicant . He further ordered that the information which is personal in nature should not be shared , the SIC order reads: "Keeping in view the request of the PIO and facts and circumstances of the matter in hand, the information seeker is advised to personally visit the office of PIO and clarify his point of view on certain queries raised by him in his RTI application. The PIO is also directed to furnish information to the information seeker as available in office record which is not personal information relating to SPOs recruited in District Poonch/ Rajouri within 3 weeks from the date of pronouncement of this order under an intimation to the Commission. The information disclosure of which would endanger the life or physical safety of any person or identify the source of information or assistance given in confidence for law enforcement or security purposes should not be shared with the information seeker." |
