DB issues various directions for saving Sheikhsar, Khushwansar lakes in valley

Jammu, Aug 5: In a public interest litigation (PIL), Division Bench of State High Court comprising Chief Justice MM Kumar and Justice Ali Mohammad Magrey Monday issued various directions for saving water bodies of Sheikhsar an d Khushwanasr.
The DB also went through the report submitted by a team of officers which was constituted to undertake inspection and submit a report to suggest the measures for saving the water bodies.
The report submitted by the committee vindicates the stand taken by the petitioner Abdul Majid Wani before the Court. Even new buildings were being constructed on the land made after filling-up one side of the water bodies. Several other violations have been pointed out which result in destroying the water bodies.
In the report Committee made observations in which it has been submitted that since major portion of water body is a wetland, they need to be preserved as such since there are important features of natural ecosystem and attract a large number of migratory birds.
The boundaries of water bodies need to be demarcated and parapet wall constructed in order to protect the water bodies from further encroachments.
The DB directed that no further constructions in these areas is allowed and if any body is found raising construction the same shall be demolished without loss of time. "
The area of lakes be demarcated and the report in this regard be submitted before the Court. The respondents shall explore the possibility of associating any expert agency for the purposes of restoring the lakes to their original beauty," the court ordered.
The DB after hearing Advocates N H Khuroo and Javed Ahmed for the petitioner and Deputy AG N H Shah for the state further restrained other Courts not to entertain any application with regard to the matter of this PIL.
The DB observed that these directions have been necessitate in view of order passed by the Supreme Court asking all the state governments that they should prepare schemes for eviction of unauthorized occupations of Gram Sabha, Gram Panchayats, Poramboke, Shamlat land and the same should be restored to Gram Sabha/Gram Panchayat for the common use of villagers of the village. Earlier the DB had directed to place on record the procedure for laying new roads or their repair like macadamization, no report has been filed and directed to file the same before next date of hearing.
The DB directed that the status report in respect of both the lakes be filed within four weeks and also directed Chief Secretary to designate one department as the Nodal Department and co-ordinate the efforts and ensure filling of one status report by nodal dept. (JNF)
