Petition seeks CBI probe into Kishtwar violence

JAMMU, Aug 30: An aggrieved father who lost his son to Kishtwar violence has filed a petition in the high court seeking a CBI probe into the clashes that shook the entire state. The police registered an FIR No 145/2013 into the clashes that left three persons dead including the son of the petitioner, Des Raj Bhagat.
Justice Virender Singh of J&K High Court Jammu Wing after hearing Senior Advocate Sunil Sethi with Advocate Parimoksh Seth appearing for the petitioner issued notice to Sajjad Ahmed Kitchloo Former Minister of State for Home Affairs J&K, Presently MLA Kishtwar, Principal Secretary Home Department, Deputy Commissioner Kishtwar, SHO P/S Kishtwar, Mohd Saleem, former Deputy Commissioner Kishtwar, Ashkoor Wani DIG Ramban-Doda-Kishtwar Range and Sunil Gupta former SSP Kishtwar returnable within two weeks.
The court directed Deputy Commissioner Kishtwar to file status report regarding investigation conducted as on date and also to file his personal affidavit within two weeks. This order was dictated in the open Court.
In the petition it has been submitted that the petitioner is a retired Subedar from Indian Army.
His son Arvind Raj has been killed by 17 bullet shorts on 9th August, 2013 at Kuleed Chowk, Kishtwar in the communal riots in reference whereof an FIR No. 145 of 2013 has been registered with Police Station, Kishtwar.
That whole of the town of Kishtwar witnessed communal riots which were worst of its kind which took place on August 9, 2013 on the eve of Eid which was being celebrated on that day.
In the petition it has been further submitted that the incident of riots, which took place on August 9, 2013 in fact started a few days earlier to that when anti-Indian posters were posted in the town as also the posters of the militants including Maqbool Bhat and Afzal Guru were pasted at different places in Kishtwar town. There were also posters which were enticing communal disruption and attributes and anti-national feelings.
In the petition it has been submitted that on people of Kishtwar were alarmed because of these pasting of posters on the walls of different buildings in Kishtwar town particularly in the Masjid area and as such number of people reported the matter to the District as well as Police Administration well in time, but no remedial steps were even taken and on August 9, 2013, the atmosphere was already surcharged and the Administration having failed to take any action was found to have encroached the separatists, militants and communal forces and immediately after Eid prayers, people in that area started raising slogans against the country and in favour of Pakistan and also slogans in favour of militants and militancy, which flared the tension which was already existing for the last few days in the past.
In the petition it has been submitted that there is no action from the civil as well as police administration to stop the aforesaid activity, this slogan raising was apparently anti-national and has the tendency of disrupting the peaceful tranquility of the town, the use of force started by the rioters. The people starting running for shelters to protect them and at that point of time there was absolutely no assistance from the civil administration as well as from local police. To the utter dismay of the locals, the Sajjad Ahmed Kichloo who at that point of time was the MOS Home of the State of J&K, and supposed to be in charge of maintaining the security, along with Deputy Commissioner Mr. Mohammad Saleem and then SSP Kishtwar went to the Government Guest House which was just at a dissonance of about 2-3 minute walk and remained inside the Government Guest House till evening. During this time all the police force and para-military personnel were made immobilized and did not take any action in the matter to stop rioting. It was apparently an deliberate attempt on the part of the respondents 5 to 8 to allow the communal riots to take place for their political or other gains and in furtherance thereof all the Government retaliatory machinery was immobilized giving free hands to the rioters to resort to frenzy and communal violence of worst kind targeting the minority community.
