LA session from October 1, Cabinet yet to approve proposal

SRINAGAR, Aug 31: The autumn session of the Jammu and Kashmir Legislative Assembly will now commence from October 1, 2013 instead of September 23 as proposed earlier by the Government (Law and Parliamentary Affairs Ministry).
Sources in the Law and Parliamentary Affairs Ministry told Early Times on Saturday that due to deferment of the Cabinet meeting which was scheduled on Friday, the Cabinet could not wet the proposal and forward it to the Raj Bhavan for issuing a notification to summon the legislature on September 23.
They said it was a constitutional requirement that the Raj Bhavan issues notice for holding the session at least one month before the date of commencement of the session but due to deferment of the Cabinet meeting the file could not reach the Raj Bhavan on due date so the Law department in consultation with the Speaker of the Legislative Assembly has to reschedule the proposal as provided in the Conduct of Business Rules.
They said the Law Department has approached the Speaker a fresh to propose a new date to be placed before the Chief Minister wherefrom it will go to the Cabinet for approval and forward to the Raj Bhavan which in turn shall issue a notification to this effect.
Pertinently the Cabinet meeting scheduled for Friday last was put on hold on the request of some Congress Ministers.
The Law Department had earlier suggested September 23rd for convening the autumn session of the state legislature and the file was also approved by the Chief Minister. Meanwhile authoritative sources in the Law and Parliamentary Ministry confirmed to Early Times on Saturday that the autumn session of the J&K Legislature would be a brief one of maximum 8 to 10 sittings.
They said the Government is not in a mood to extend the duration of autumn session, which used to be normally convened for 10 days every year since 1996.
"There is persistent demand from legislators to increase the duration of the session held every year for 10 days as they are of the opinion that many issues of public importance remain untouched during such a brief sessions", sources said . They said the Speaker, Mubarak Gul was seriously thinking on the demand but the Government has categorically turned down the demand.
"Government has yet not decided for how many days session will last but it is sure that the session will not last for more than 7 or 8 days" said the sources.
Pertinently, while most of the State assemblies hold nearly 50 sittings annually, in Jammu and Kashmir the legislature hardly meets for 30 to 32 days.
The budget session held in February-March at Jammu runs for 25-26 days, at Srinagar the autumn session held every year in the month of September or October lasts just for eight to ten days.
