DB restricts construction at Katra Railway Station responding PIL over illegal construction

Jammu, Sept 6 : In a Public Interest Litigation (PIL) regarding illegal construction be carried around the upcoming Railway Station Katra, Division Bench (DB) of State High Court comprising Chief Justice MM Kumar and Justice Hasnain Massodi after hearing Adv Ajay Sharma appearing for the PIL whereas AAG Seema Shekhar appearing for the State ordered that till next date of hearing all construction activities in the Municipal Area Katra including the area around Railway Station by all and Sunday are stooped. Division Bench further observed that the aforesaid directions have not been complied with and an application has been filed with a prayer for grant of extension of two weeks time. DB further said that the way whole issue concerning construction at Katra has been delt be at the level of CEO Katra Development Authority and others leave much to desire.
Pertinently the matter concerning illegal construction violating master plan is pending consideration of CEO since 2011 as is evident from the facts that the Deputy Commissioner Reasi in his communications has been informing the CEO Katra Development Authority with regard to illegal construction which is being carried out in the year around railway road and thereafter illegal construction has been carried on unabated. "Even the direction issued by this Court on July 30, 2013 has not affect, the Division Bench was informed besides that construction is raised during night and holidays in connivance with the "independent officers.
Division Bench further observed that in the application seeking extension of time, the Divisional Commissioner and other officers could not undertake visit to the area for the reasons of curfew and the situation in the Kishtwar. However, it appears that those events have no effect on the construction activities which are alleged to be carried during night time and holidays.
Division Bench took serious note and observed that a blanket order would be warranted in order to control the situation so that the officer concerned may identify the illegal as well as legal constructions and ordered that till next date of hearing all construction activities in the Municipal Area Katra including area around Railway station by all and Sunday are stooped. Division Bench also ordered that IGP Jammu, SSP Reasi, SP Katra and Deputy Commissioner of the area to ensure compliance of the order. If any, information regarding violation of this order is received than the officers shall be responsible. The petitioner in PIL has alleged that a big land mafia has constructed shops/ hotels unauthorized manner around the Railway Station Katra and are going ahead presently also as all these constructions start at night and ends in the early morning. It is further alleged that Katra Development Authority headed by Chief Executive Officer has turned blind eyes towards all these violations.(JNF)
