| Rape accused acquitted as medical evidence fails to support charge of rape | | | Et Report
Jammu, Sept 7 (JNF): Principal Sessions Judge Udhampur has acquitted one Rohit Sharma who was facing trial in rape case as the medical evidence does not support the charge of rape. Principal Sessions Judge Udhampur AK Koul after hearing both the sides observed that e case is a failure gets fully justified from the statement of the prosecutrix itself. Even otherwise also the medical evidence does not support the charge of rape. Prosecutrix was allegedly raped on 23.05.2010 and on 24.05.2010 she was examined medically but no evidence of rape was found whereas the statements of victim's parents do not lead anywhere because they have only given hear say which does not have any evidentiary value. So the court is constrained to say that the case is a failure which is accordingly dismissed and the accused is acquitted. According to the police case that report was lodged by prosecutrix, alleging that accused assaulted her sexually for over a period of one year deceitfully by saying that he belonged to a low caste family and wanted to marry her. It was on this promise of accused she allowed him access to her privacy and finally the accused allegedly took her to Udhampur, confined her in a room for three days, exploited her sexually, and finally declined to marry her saying that he was a Brahmin by caste and so the report. During investigation statement of the prosecutrix was recorded in terms of section 164-A Cr.PC. She was got medically examined and after conclusion of investigation the complicity of accused in commission of afore mentioned offences was established and so the investigation culminated in this charge sheet. |
