| Distt adm fails to stop illegal activities on Govt land despite court orders | | | Kathua Sept 7: The District administration besides revenue staff equipped with contingent of police virtually failed to take any action to stop the illegal activities/encroachments of 34 kanals and 18 marlas of forest land Rakh Sarkar Palahi on the east bank of Sahar Khad land been acquired by the State Govt for establishment of University Campus at Kathua and seems to just standing as mute witnesses. As per reports High Court of J&K has passed an interim order dated 26 Aug 2013 on CMA No 1619/2013 directing the respondents (DDC Kathua) to restrain from finalizing the allotment as regards forest land pursuant to Govt Order No REV/S/08 of 2010 dated 22-01-2010 till next date before the bench. The case pertains to allotment of 34 kenals and 18 marlas of forest land of village Rakh Sarkar Palahi on the east bank of Sahar Khad, the land had been acquired by the State Govt for establishment of University Campus at Kathua. The general public of Kalibari has approached the High Court of J&K, Jammu for cancellation of said Govt Order as the said land being allotted to the persons, whose land has been acquired by the State Govt for construction of University campus at Kathua is a Forest Land, which cannot be utilized by the State Govt for any purpose other than growing the forest therein. Petitioners said that the action impugned is violation of article 19 (i) (g) of the constitution. The petitioners also added the farmers whose land has been acquired by the state government may please be allotted fertile land at some other place so that they can earn their livelihood. Meanwhile on this Sept 5- 6 persons who are being allotted said land had tried to forcibly occupy the said land through muscle powers but they could not succeed and in a press conference on 06 Sep 2013 some bureaucrat turned politician openly challenged the administration that they will forcibly occupy the land at 11 AM on today (Sept 7). In the meantime the general public of Kalibari met DDC Kathua and submitted an application that said persons have openly challenged the administration that they will forcibly occupy the said land and requested for the protection of the said land by placing police over there. While DDC Kathua who is respondent in the above Court Order assured the general public of Kalibari that directions of High Court Order dated 26-09-2013 shall be complied with in letter and spirit yet a mob forcibly started occupying the said land by erecting the pillars and barbed wire. When the news of forcibly occupation on land in question, the Deputy Commissioner (DC) Kathua sent Jatinder Mishra (Tehsildar Kathua) and other revenue staff along with police force but they failed to stop the illegal activities. |
