Jammu, Oct 9 (JNF) : Principal Sessions Judge Jammu Kartar Singh today awarded three years rigorous imprisonment and fine to Faryad Ali and Jamal Din r/o Raipur Morh Domana, Jammu after twenty years trial and investigation.
According to the police case that 27.6.1993 the complainant Shambo Nath was admitted in an injured condition in the hospital where his statement was recorded by the SHO in which he stated that the accused and Qadeer were having enmity with him regarding land and Saleema wife of Alam Din had filed an FIR against him under the provisions of section 354 RPC and that case was a false case. On 27th June 1993 at 11 AM he was grazing cattle in his land along with his wife Sheela Devi and goats of Kali came in his land and started causing damage to mango trees. When his wife tried to get away goats from his land, Mst. Kali Gujjari also came there and his wife asked her to take care of their goats as they had caused damage to the mango trees. Mst.Kali got infuriated and asked her daughter-in-law and Mst. Shamshad to call Qadeer, who also came there after arming himself with a gun. All the three ladies caught hold of him and the accused Qadeer started beating him with rifle butt. On hearing noise, his father also came on spot who was also beaten and he sustained wound on his head. They forcibly tried to kidnap him but he saved himself with great difficulty. He came to his home and thereafter he and his wife started going towards police station along with his father and when they reached Raya more, the accused Gunu came there with a truck and tried to over run them but they saved themselves by turning towards one side. Hamida son of Fazal Din were also present there and they asked them to go to police station from link road and when they reached near Bhagani talab (pond), the accused Faryad Ali came there who was armed with a revolver. Hamid and Hamida asked the accused not to fire at them but he fired at him with an intention to commit his murder and the shot hit his abdomen and thereafter he left the place. He was taken to the hospital and his wife went towards police station for lodging report. The court after hearing Special Public Prosecutor LK Sharma with Adv Vishal Sharma appearing for the State whereas Sr. Adv Sunil Sethi appearing for the accused acquitted four accused namely Mst. Kali, Mst. Shamshad, Saleema and Dalbir Hussain as prosecution failed to prove the charges against them and convicted Faryad Ali and Jamal Din and awarded three years RI and fine Rs 10,000 each. |
