| Directs to provide information related to appointment of daily wagers | | SIC issues penalty notice to Xen PDD Kathua | | Early Times Report JAMMU, Oct 9: The State Information Commission has issued a penalty notice to the Executive Engineer Electric Maintenance and RE Division Kathua (PDD) for not providing the complete information to an information seeker under the State RTI Act 2009 . The Chief Information Commissioner (CIC) GR Sufi while issuing the orders on October 1st has directed the Xen PDD Kathua who is also the concerned PIO to provide the requisite information sought by RTI applicant within 15 days to him. The details available with Early Times reveal that a second appeal under State RTI Act 2009 was filed by one Shiv Shanker Sharma before the State Information Commission (SIC) on 23.8.2013. After receipt of said second appeal, the Registry of the SIC posted the appeal for hearing. Accordingly, First Appellate Authority (FAA) and Public Information Officer (PIO) and the Appellant Shiv Shanker Sharma attended the hearing and all the three parties were heard by the Commission . Shiv Shanker Shrama filed an RTI application before the PIO in the office of Executive Engineer, Electric Maintenance and RE Division Kathua which was sent by post on 24.4.2013. The PIO passed an order under No: KED/TS/RTI/867-68 dated 22.05.2013. The RTI applicant had sought following details about the engagement of Daily Wagers on need basis , their complete bio data, officials who engaged them , qualifications etc; Whether the wages of these daily wagers are being paid through Hand Receipts, Muster Sheets or any other manner specifying mode of payment. Whether the wages of these daily wagers are being drawn against the funds allocation for new schemes/works or against the allocation for maintenance/repairs? Up to date amount of expenditure made for payment of wages to these daily wagers engaged on need basis; Latest status of each Daily Wager so engaged after the issuance of Circular No: 09-GAD of 2013 dated: 26.03.2013. The State Information Commission (SIC) while issuing the orders said "The PIO is directed to give latest status of each daily wager so engaged after the issuance of Circular No: 09 of Gad of 2013 dated: 26.03.2013. Details of such daily wagers which are engaged even after 26.3.2013 in accordance with the above circular be given in an affidavit duly attested by Notary, a copy of which be submitted to the Commission. These points were raised in appeal and even before FAA vide Appellants first appeal dated: 11.6.2013. Unfortunately, the FAA not appreciating the import of his public authority as laid down in the Act under Section 16 has not appreciated the gravity of his responsibilities. This part of information is quite important so far as transparency and accountability is concerned. Therefore, in order to uphold the mandate of the Act this information should have been given without any reservation" The SIC directed the PIO to provide this information to the appellant within 15 days from the receipt of this order. |
