Court awards 5 years imprisonment to 2 in murder case

Jammu, Oct 9 : (JNF) Principal Sessions Judge Udhampur AK Koul today awarded five years imprisonment and fine Rs 10,000 each to Rattan Singh S/o Bindu and Rangil Singh S/o Chuni Lal u/s 304-II (culpable homicide not amounting to murder).
On 23rd of July 2009, when the accused were participating in a marriage ceremony in the neighborhood of Kewal Kumar (hereinafter referred to as deceased). As per the First Information lodged by PW Bimlo Devi it was around 10 p m when she alongwith her family members including her deceased son Kewal Kumar were also present in the marriage ceremony.
It is alleged that the accused picked up a quarrel with deceased and ultimately the accused pushed the deceased about 40 ft down as a result of which the deceased sustained severe injuries in his back. He was shifted to hospital on 24th Julyand a case FIR NO. 17/09 under sections 307/323/341/34 RPC was registered against accused in police station Basantgarh. After completion of investigation challan was presented in the court of law.
The court after hearing Adv Ajay Bandral for the accused person whereas PP Navneet Gupta for the state observed that after considering the aggravating and mitigating circumstances put across by counsel for parties and keeping in view all other relevant factors like the manner in the crime was committed, weapon used by accused, the age, social status of accused, their domestic problems etc, I believe that the submission of accused merits consideration.
Rattan Singh being a police official would lose his job which would not only affect him but also his family as well.
He has an old aged mother and wife who is suffering from tuberculosis. Rangil Singh is young man of 26 years of age and his future is virtually ruined, even if a lesser sentence is imposed on him. That being so the ends of justice would be met with if a lenient view is taken against the accused/convicts while awarding the sentence and awarded five years imprisonment and fine Rs 10,000 each to both the accused persons.
