Srinagar, Nov 22: Jammu and Kashmir High Court today directed personal appearance of Director School Education, Kashmir, for Monday to explain why an upgraded school in north Kashmir's Bandipora village has been deprived of two teachers for last three years. A single bench of Justice Ali Mohammad Magrey passed the directions while hearing a petition filed by Adil Nabi Mir for being aggrieved of Education Department's failure to finalize the selection of two ReTs for the upgraded Primary School at Muslim Abad Bandipora. "There is no scope under law for the respondents to keep the process of selection pending once initiated," the court said, adding, "The object of the Scheme launched by the authorities is only to ensure the availability of teachers on Fast Track mechanism in villages or areas where teachers are not available." The education department, court observed, failed to adhere to the provisions of the Scheme which is detrimental to the interest of children of the Bandipora village. "The Policy makers in orders provide proper education to the children of far flung as to ensure implementation of the fundamental right of the children of the village," the court said, directing DSEK to remain present on November 25. The court directed Registrar Judicial to ensure presence of the Director on next date of hearing. "In-case the Director fails to appear on his own, there shall be no option but to secure his presence by coercive method," the court said. |
