| Court acquits accused of murder charges | | Strictures against COPs, probe through IGP SVO/Crime | | Jammu, Dec 23 : In a significant judgment passed by 2nd Additional Sessions Judge Jammu Nighat Sultana in much publicized murder case of Liaqat Ali, Dilawar Singh alias Bhola who was facing trial and investigation for the last 11 years was acquitted of charges. While acquitting the accused person, 2nd Additional Sessions Judge Jammu Nighat Sultana after hearing APP for the state whereas Adv Rajesh Kotwal for the accused, expressed anguish/displeasure over the tainted investigation and observed that the revelation made by the police officer amounting to gross misconduct and misuse of official position by his superiors needs to be probed thoroughly. Court directed that a copy of Statement made by prosecution witness (police official) namely Ajay Suman along with copy of this judgment be forwarded to DGP J&K with the directions that he shall hold a probe in the matter so as to ascertain the facts. DGP should get the matter investigated from an officer not below the rank of IGP preferably through Vigilance or Crime Branch wings of JKP. According to the prosecution story police station Channi Himmat lodged FIR No 94/2002 for commission of offence u/s 302 RPC and investigation was entrusted to SI Ajay Suman Gupta thereafter investigation changed hands to number of IOs and at the last ASP BS Tuti (IPS) SDPO City East Jammu carried forward the investigation and completed the same and presented the challan. After a full-fledged trial, Court acquitted the accused on the ground of unfair/inefficient investigation and passed serious remarks over the functioning of the Senior Police officers who miserably failed to investigate the crime and finally acquitted the accused due defective investigation. |
