| HC grants bail to eight petitioner in Kishtwar riots | | | ET Report Jammu, Jan 9 : Vacation Judge of J&K High Court Jammu Wing, Justice Bansi Lal Bhat has granted bail to Neeraj Kumar alias Kaku, Sanjay Kumar, Ranjeet Kumar, alia Nittoo, Koshal Kumar, Shakti Kumar, Narinder Kumar alia Dany, Sewa Ram and Milan Singh who were allegedly involved in Kishtwar Riots. While granting bail to the petitioners, Justice BL Bhat directed that upon surrender of petitioners they shall be released on bail on furnishing personal bond and surety bond in an amount of Rs 30,000 each to the satisfaction of Special Judge Kishtwar. While disposing of the petition Justice BL Bhat observed that petitioners figures as accused in case registered under FIR No. 150/2013 registered with Police station, Kishtwar. They are alleged to have committed offences including offence u/s 436 RPC which is triable by Special Judge. During the course of hearing it emerge that some of the accused in FIR have already been admitted to bail. In view of the mandate of law engrafted in section 295-A r/w section 497-D of CrPC providing that the investigation shall be concluded within two weeks and trial shall as far as possible be concluded within a period of three months coupled with the fact that in the instant case pending trial before the Special Judge Kishtwar the trial is shall to take off for one reason or the other including the fact that some of the accused are at large and superadded to it that fact that surcharged atmosphere is said to have prevented the petitioner from gaining access to trial court and seek bail. This petition is disposed of by directing that upon surrender of petitioners, they shall be released on bail on furnishing personal bond and surety bond to the amount of Rs 30,000 each to the satisfaction of Special Judge Kishtwar. Court further observed that in so far as grounds urged for quashment of charge-sheet are concerned, petitioners shall be at liberty to raise these questions at the stage of framing of charge before the Trial Court.
