| HC suspends imprisonment, grants bail of Patwari | | | early times report
Jammu, Jan 9 (JNF): Vacation Judge of J&K High Court Jammu Wing Justice BL Bhat today granted bail and suspended the sentence of Mohd Razaq who was convicted by the Special Judge Anticorruption on December 31, 2013 in corruption case.
Justice BL Bhat after hearing Sr. Adv Sunil Sethi with Adv Parimoksh Seth appearing for the petitioner whereas AAG Ravinder Sharma appearing for the state suspended the sentence and granted bail to Mohd Razaq and directed that he shall be released on bail subject to furnishing personal bond and surety bond to the tune of Rs 25000/- each and also filed undertaking to appear before this court on each and every date and serve the sentence if his appeal is not allowed.
Court further directed that he shall not be released unless he deposits the amount of fine imposed by the Trial Court with Registrar Judicial.
According to case the criminal appeal filed seeking setting aside the conviction and order of sentence dated 31.12.2013 passed by the court of learned Special Judge, Anti-Corruption, titled State v/s Mohd. Razaq and another by virtue of which the appellant has been held guilty for commission of offence under section 161 RPC read with Section 5(1)(d) and 5(2) of the J&K Prevention of Corruption Act and has been sentenced to undergo imprisonment for a period of one year and liable to pay fine of Rs.5000/- for offence under section 161 RPC and imprisonment for a period of one year for offence under section 5(1)(d) read with Section 5(2) of the J&K Prevention of Corruption Act and fine of Rs.5000/ and both the sentences are directed to run concurrently. |
