| Despite lapse of 3 years no FIR registered against then Deputy Commissioner Srinagar | | Then Divisional Commissioner Kashmir detects fraud in mutation | | Jehangir Rashid SRINAGAR, Feb 11: The recent alleged delay by police in registering First Information Report (FIR) against erstwhile Health Minister, Shabir Khan is not new as in the past police has been found wanting in taking action against the people who matter in the government or administration. On April 19, 2011 the Divisional Commissioner Kashmir, Asgar Hassan Samoon after finding something fishy in a case of mutation ordered for registering FIR against then Deputy Commissioner, Srinagar, Mehraj Ahmad Kakroo. Almost three years down the line no FIR has been registered against Kakroo who is nowadays Managing Director, Jammu & Kashmir State Power Development Corporation (JKSPDC). "It is prima facie observed that mutation has been attested under Roshni for the share of the deceased lessee. Besides, an amount of Rs 30 lakhs has been deposited against the assessed amount of Rs one crore per kanal. FIR needs to be lodged against the delinquents and Deputy Commissioner concerned," writes Samoon in the order. The then Divisional Commissioner, Kashmir further writes in the order, "However, Additional Deputy Commissioner and Assistant Commissioner Nazool will proceed on spot and get the land located/demarcated and have a detailed report submitted to this court within a period of 15 days after perusal of records and spot." Samoon passed the order on the petition of one Ali Mohammad Bhat son of Abdul Ahad Bhat resident of Nawab Bazar, tenant of shop number 10 Banaras Silk Emporium Shopping Complex Srinagar. Ali Mohammad moved the petition while seeking revision of order of mutation number 486 dated 23-11-2010 of estate Kothi Bagh Srinagar with the prayer for setting aside the same. It is the same chunk of property for which the Amira Kadal branch of Jammu & Kashmir Bank sanctioned a term loan facility of Rs. 450 lakhs on 21-2-2011 in favour of the quartet of Khan Brothers running business in the heart of the city. This was despite the fact that title of land was yet to be decided on that date and the same is still a mystery three years down the line. "Immovable property comprising of three storeyed residential house along with possessory rights in a total piece of land measuring 3 kanals and 3 marlas 264 square feet underneath and appurtenant thereto falling under Survey numbers 148, 149, 150 and 151 min khewat number 59 min khata number 131 min situated at Estate Residency Road, Mouza Kothi Bagh Tehsil Khas District Srinagar standing in the name of Imtiyaz Ahmad Khan, Riyaz Ahmad Khan, Mushtaq Ahmad Khan all sons of Noor Mohammad Khan and Tasleema Akhter wife of Farooq Ahmad Khan all residents of Hyderpora, Srinagar. The mortgage confirms upon the bank an undisputed right and creates a charge upon the aforementioned property, writes Associate Executive, Credit, Jammu & Kashmir Bank, Branch Unit Amira Kadal. The bank authorities shot the above mentioned communication to Tehsildar (Khas) Srinagar with the request that concerned Patwari of the Estate may be directed to enter into his register of records the acquisition of the right of the Bank in terms of section 24 of the Revenue Act which shall till liquidation of the loan, whereafter an intimation of wavier of such change and shall be accorded by our office. Sources said that the three soreyed residential house as referred to by the bank authorities never existed at the site with only hotel Sabreena running its business at the mentioned site. The sanctioning of the term loan facility by bank authorities created ruckus with the shopkeepers of Fairdeal shopping complex objecting to the same. |
