| Court acquits husband in wife's killing as prosecution fails | | | Early Times Report Jammu, Feb 26 (JNF): Principal Sessions Judge Kathua AK Koul today acquitted Raj Kumar who was facing trial in murder of his wife Neelam Jyoti on the issue that she has given birth to second time again daughter as prosecution miserably failed. After hearing both the sides, Principal Sessions Judge Kathua AK Koul observed that Court is of the considered opinion that this case does not stand on a sound footing. The case as such, fails and is accordingly dismissed and thus accused is acquitted of all the charges. "He is in custody. He shall be set free provided he is not required in any other case, court said. According to the police case that a verbal report lodged by the father of Smt Neelam Jyoti wherein he has alleged that deceased was married to accused since 2006. The couple was blessed with a daughter two years before and the second daughter was born to the deceased 10/12 days before the alleged occurrence. The accused was annoyed with deceased on her giving birth to a second girl child and so he would usually quarrel with her and was even telling her that he would go for second marriage and even had threatened to kill her. On 31.10.2009, at about 11 a.m, he (father) came to know that accused had throttled the deceased to death. On this police registered a case u/s 302 RPC and after completion of investigation challan was presented in the court. |
