| SIC directs PFO to reveal information | | Non payment of provident fund to SRTC employee | | Early Times Report
Jammu, Feb 26: The State Information Commission (SIC) has directed Provident Fund Organisation J&K to reveal information under RTI Act about the delay made by the department in the payment of provident to an SRTC employee. The employee has filed an application under RTI Act and the department had provided incomplete information to the employee .
As per details available one Vijay Kumar Khajuria (Ex. Senior Assistant) from Gourkha Nagar, Bahu Fort, Jammu moved an application dated 26-06-2013 before the Public Information Officer (PIO) in the office of Provident Fund Office, Railway Road, Jammu under J&K Right to Information Act, 2009 wherein he sought the following details :
a. Time and date of deposit of provident fund and amount with interest.
b. Whether the amount doubled and how much the SRTC office has not deposited the amount from time to time and the interest accrued upon the amount, give detail report.
c. Why the payment was not made on 31st July, 2012 and was made on 22-06-2013 give the detail report.
d. Furnish the detail report also of those amounts which have been deposited after the due period, give detail of amounts and report of interest accrued upon it.
The PIO/Chief Accounts Officer, J&K Employees Provident Fund Organization, Rail Head Complex, Jammu furnished the requisite information consisting of 32 leaves to the information seeker vide office No: Addl. PFC/J/129 dated 25-07-2013. However, the information seeker was not satisfied with the same and moved Ist appeal dated 02-09-2013 before the First Appellate Authority (FAA) where-under he alleged that the PIO has not provided the complete information as sought by him and subsequently the information seeker filed second appeal dated 27-11-2013 before the State Information Commission (SIC) in which he has alleged that he has not been paid interest on the GP Fund deposit.
After going through the contents of the RTI application and submissions made by the appellant show that wanted information relating to query No. (c) raised in the RTI application. On the last hearing dated 29-01-2014, the PIO was directed by the SIC to furnish the requisite information relating to query number C within a week's time and also file compliance report to the Commission. The PIO failed to furnish the requisite information to the information seeker relating to query number C and has also not filed any compliance report.
The PIO/Chief Accounts Officer, J&K Employees Provident Fund Organization, Rail Head Complex, Jammu has reiterated vide office letter No:Addl.PFC/J/129 dated 25-07-2013 that the information sought by the information seeker in his RTI application stands furnished to him. However, the information relating to query No C raised by the appellant in his RTI application remains unanswered. Taking strong note of the issue the SIC directed the PIO cum Chief Accounts Officer of Employees Provident Fund Organization that the information be provided within a week's time. The SIC order dated 24.2.2014 reads as under :
"The PIO/Chief Accounts Officer, J&K Employees Provident Fund Organization, Rail Head Complex, Jammu is hereby directed to provide the requisite information to the information seeker with respect to query No C within one week from the date of receipt of this order and file compliance report to the Commission. |
