HC takes cognizance of contempt petition, seeks record

JAMMU, Mar 24 : In a contempt petition filed by Shahnaz Akthar, the High Court of J&K summoned the entire record from the respondents Mohammad Iqbal Khanday, Chief Secretary, State of J&K, Mohammad Ashraf Bukhari, Commissioner secretary to the Government (GAD) and Mohammad Farooq Factoo, Commissioner/ Secretary Industry and Commerce Department.
After hearing Advocate Irfaan Khan, Justice Tashi Rabstan directed respondents to produce entire record on the next date of hearing.
While advancing the arguments, Advocate Irfaan Khan submitted that the respondents have violated the court directions passed in the petition filled by Shahnaz Akhtar and just to defeat the purport of the directions have passed the order dt. 25-01-2014 by virtue of which the claims of the petitioner for fixation of her seniority in the list of Project Managers in Industries & commerce department have been rejected.
The respondents were under an obligation to implement the directions by accepting the claims of the petitioner by fixing her seniority in the list of Project Manager after deleting from the seniority list of Functional Manager and further her induction in KAS w.e.f 22-07-2008 under ST Category with all the consequential benefits, as the writ petition had been allowed by the Court vide Judgment dt 04-02-2013 and there was no room for the respondents to reject the claims of the petitioner and as such the respondents are required to be proceeded in terms of contempt of Court Act.
The court has fixed the matter in the week commencing 7th April 2014.
