| Three awarded 2 yrs imprisonment, fine in 'murder assault' | | | Jammu, Mar 25 (JNF) : Principal Sessions Judge Kathua AK Koul today awarded two years imprisonment and fine Rs 5000/- each to two accused facing trial in murderous attack on one Prakash Chand, on 08.10.2007 After hearing PP Ravi Gupta for the state whereas Adv TN Gupta for the accused persons, Principal Sessions Judge Kathua AK Koul observed that Parshotam Lal s/o Dharam Chand, Damnesh Kumar s/o Ram Chand and Rakesh Kumar s/o Parshotam Lal all residents of Pathwal, Tehsil Hiranagar, have been convincingly proved to have assaulted the injured thereby inflicting grievous injures to him. They are, accordingly, convicted u/s 325 r/w Section 34 RPC but further observing the trauma, pain and loss of financial resources, they (accused) have suffered since last six years, so any harsher punishment would not only put them to peril, but would also affect their families adversely thus each of the accused is sentenced to undergo imprisonment for two years and also to pay a fine of Rs. 5000/- u/s 325 RPC. The accused launched an assault on the injured, allegedly with intention to kill him while one of the accused namely Rakesh Kumar attempted to hit the injured on his head, but injured raised his hand in defence, and the weapon hit his right arm, which got injured seriously. Other accused also attacked the injured resulting in serious injuries to him. On this police registered a case and after completion of the investigation challan was presented. |
