| DB directs Com/Secy CAPD to file status report or appear in person | | PIL regarding misappropriation of food grains | | Jammu, Mar 24 (JNF): In a Public Interest Litigation regarding misappropriation of food grains meant for public, A Division Bench of State High Court comprising Chief Justice MM Kumar and Justice Muzaffar Hussain Attar after hearing Adv S K Shukla as court counsel whereas AAG Ravinder Sharma for the state, directed Commissioner/Secretary to file status report which shall also disclose the cases which might have been registered against the erring officers in the past and what action has been taken against the officers involved in Dachhan scam. In case the status report is not filed by the date fixed then Commissioner/Secretary to Govt CAPD Department shall remain present in person.
When this PIL came-up for hearing, Division Bench observed that Notice in this PIL was issued on December 10, 2013 highlighting the colossal misappropriation by disappearance good grain meant for public distribution to the resident of the area like Dachhan (Kishtwar). In respect of one year period from April 2012 to March 2013 a shortfall of food grain worth more than Rs.48.00 lac has been reported. The matter came to the notice of this Court when the officers sought to be transferred on the allegation of shortfall of food grain approached this Court against their transfer and posting. In the order it has been made clear that the said shortage for the year 2012-2013 is only a tip of iceberg. However, the order has not awakened the respondents and no status report has been filed despite various opportunities.
Division Bench further observed that Keeping in view the seriousness of the issue involved and the adverse conditions in which people of the State are living in far flung area where misappropriation of food articles has taken place and directed the respondents to file status report.
The status report shall also disclose the cases which might have been registered against the erring officers in the past and what action has been taken against the officers involved in Dachhan scam. In case the status report is not filed by the date fixed then Commissioner/Secretary to Govt., CAPD Department J&K Civil Secretariat, and Jammu shall remain present in person. |
