| Alleged HM Militant acquitted as prosecution fails | | | Erly Times Report Jammu, May 15 : Principal Sessions Judge Jammu R S Jain today acquitted Majid Hussain an alleged Hizb-ul-Mujhadeen (HM) ultra facing trial in 3/ EAO, 3/12 Pass Port Act, 2/3 EIMCO. Principal Sessions Judge Jammu R S Jain observed that prosecution is under an obligation to prove the guilt of accused by cogent clear evidence but in the present case, there is not an iota of evidence adduced by the prosecution to connect the accused with the commission of offence with which he is charged. With these observations the court acquitted accused Majid Hussain of the charges leveled against him. According to the police, following an information the accused along with other militants had gone to the Pakistan to receive arms training and thereafter they started militant activities in Jammu and Kashmir after returning to state an FIR was registered. During investigation, the accused was booked u/s 3 EAO Act, 3/12 Pass Port Act and 2/3 EIMCO and a challan was filed in this court. It is worthwhile to mention here that one of the accused namely Farid Ahmed had already acquitted on April 30, 2013 who booked under same sections after police recovered a pass port bearing No. EJ4116781 dtd 2nd November, 2008 issued by the Republic of Pakistan, one identity card issued by Forward Sports Pvt Ltd Wazirabad Sialkot Pakistan and three SIM cards were recovered from the personal frisking of accused.
