| Whistle Blowers Protection Act a distant dream in J&K | | Will Omar ensure safety to stoolpigeons ? | | Early Times Report
Srinagar, May 21: Government of India notified Whistle blowers Protection Act 2011 in its officials gazette on May 12 recently. This law provides for the public interest disclosure and protection to whistle blowers but as far as Jammu & Kashmir state is concerned the enactment of Whistle blowers Protection Act seems to be a distant dream as the state has not even prepared a draft bill regarding the said act. Whistle blowing is the act of disclosing information by an employee or any stakeholder (activist, media person etc) about an illegal or unethical conduct within an organization. The Whistleblower Protection Act seeks to establish a mechanism to receive complaints relating to disclosure on any allegation of corruption or willful misuse of power or willful misuse of discretion against any public servant and to inquire or cause an inquiry into such disclosure and to provide adequate safeguards against victimization of the person making such complaint and for matters connected therewith and incidental thereto. Narendra Modi led National Democratic Alliance (NDA) Government would be sworn in within a few days and the promises made by BJP during its poll campaign have to be addressed with top priority. Indian Media, civil society and public at large would be closely monitoring how quickly the BJP led Government addresses the issues related to transparency, accountability & good governance. Many RTI users, activists, people associated with media and grass root level workers for social justice, human rights and accountability have been blowing the whistle on wrongdoing and facing the ire of vested interests. The new Government will have to act on its pre election promises of ensuring accountability for wrong doing in government and protect those who expose such wrong doing (whistleblowers). As we know that under Article 370 Central Government legislations are not applicable to J&K state unless they are ratified by our state Government or a similar law is enacted , so in this context the Whistle Blowers Protection Act (WBP Act) won't be applicable to J&K state, it is impressed upon the NC led Government to ensure enactment of this law in J&K. Until the J&K Whistle Blowers Protection Bill is drafted and introduced in the state legislature the Chief Minister must immediately issue an ordinance regarding this matter so that whistle blowers from our state also get legal protection from being harassed and getting victimized at the hands of criminal and corrupt mafia. |
