Court frames charges in forgery, cheating of Rs 65 Lakh

JAMMU, May 21: Principal Sessions Judge Jammu RS Jain framed charges against Mohd Kais who was challaned the police in cheating and forgery of Rs 65 lakh. After hearing both the sides, Principal Sessions Judge RS Jain observed that a prima facie offence u/s 420/ 467/ 468/ 471 RPC is made out against accused and accordingly accused Mohd Kias is charge sheeted for the said offences. According to the prosecution case against accused Mohd Kais is that complainant Sheikh Mujeeb filed an application in the Court of CJM, Jammu who vide order dated 9/3/2012 forwarded the complainant to the concerned police station for necessary action u/s 156 (3) CrPc.As per the complainant, he had been in possession of land measuring 16 kanals in survey No. 54, 55, 56 and 41 situated in village Sunjwan Bathindi, Jammu. One Mangta along with some persons interfering with the possession of the complainant, a civil suit was filed on 9/6/2007 in the court of 2nd Addl.Munsiff, Jammu wherein parties were directed to maintain status quo on spot. Thereafter accused Mohd Kias alongwith other persons tress passed into the land of the complainant whereupon on direction of Sub Judge, Jammu, an FIR was lodged in Police Station Trikuta Nagar, Jammu. Later complainant and the accused persons entered into a compromise whereupon the complainant agreed to sell the land to accused Mohd Kias for Rs75.00 lakhs and an sale agreement was attested before the Public Notary. Meanwhile accused produced two receipts amounting to Rs35.00 lakhs and 11.00 lakhs before Incharge, Police Station Trikuta Nagar, Jammu whereas the complainant denied that he has neither received any amount from the accused and nor has he signed the receipts produced by the accused. On receipt of the complainant, FIR No53/12 for offence u/s 420/467/468/471 RPC was registered in police station Bahu Fort, Jammu against the accused Mohd Kias. On the conclusion of the investigation, the I/O came to the findings that accused Mohd Kias had prepared the forged documents in the shape of cash receipts in the name of complainant and and finding the accused guilty of offence u/s 420/467/468/471 RPC presented the challan against the accused.
