| 2 yrs imprisonment awarded to Patwari in trap case after 8 yrs trail | | | Early Times Report
Jammu, May 24 : Special Judge Anticorruption Puneet Gupta today convicted Madan Lal then Patwari Halqa Satwari who was caught-red-handed by the Vigilance Organization in the year 2006 while accepting bribe from the complainant and awarded 2 years imprisonment and fine Rs 30,000/-. After hearing CPO Harminder Singh for the VOJ whereas Adv RK Kotwal for the accused, Special Judge Anticorruption Jammu Puneet Gupta today observed that the illegal act of the accused in demanding the bribe was done in capacity of public servant and prosecution has been able to prove its case against the accused beyond shadow of doubt for the offences u/s 161 and 5(1) (d) r/w section 5(2) PC Act and sentenced the accused to undergo imprisonment for a period of one year and fine Rs 15000/- for the offence u/s 161 RPC and accused is also sentenced to undergo imprisonment and fine Rs 15000/- for the offence u/s 5(1) (d) r/w section 5(2) PC Act. Court further clarified that the both the sentences shall run concurrently and sent the accused to District Jail to serve the sentence. According to the case, on a written complaint lodged by Gurjeet Singh against the accused Madan Lal who was then Patwaru Chatha, Satwari alleging that as he intended to purchase 11 Marlas of land from one Balwant Kour, he approached the Patwari to get Fard in order that the sale deed is executed. The patwari told the complainant to file application on behalf of Balwant Kour and get it marked in his name. The complainant did it accordingly and Patwari demanded Rs 11000 as illegal gratification from the complainant and for preparing Fard. On this VOJ registered an FIR NO 05/2006 and laid a trap and caught red-handed while accepting bribe Rs 9000/- and after completion of investigation challan was presented in the court. (JNF) |
