| SIC directs BDO to furnish information | | | Early Times Report
Jammu, May 28: The Block Development Officer (BDO) of block Dhansal in Jammu has been directed by the State Information Commission (SIC) to provide details about the developmental works executed in Nagrota area to an information seeker who had sought the information under State Right to Information Act (RTI). The BDO had earlier not provided the said information which prompted the information seeker to file an appeal before SIC.
According to details available a person namely Subash Prasher S/O Late Ram Chand a resident of Nagrota, Tehsil and District Jammu moved an application dated 12.10.2014 under Jammu & Kashmir Right to Information Act, 2009 before the PIO in the office of Deputy Commissioner, Jammu wherein he sought the following information:
1. Information regarding deduction of Rs 100 from Panchayat members by the BDO office
2. Detailed description of works done by Panchayat Nagrota along-with description of the funds utilized.
3.Information regarding number of works sanctioned in Panchayat Nagrota which haven't been executed.
The Assistant Commissioner Development, Jammu forwarded the application of the information seeker vide office No. ACDJ/RTI/2013- 14/10361-63 dated 30.10.2013 to BDO, Dansal with a direction to provide the information to the applicant under rules. However, feeling aggrieved of inaction on the part of PIO/ Block Development Officer, Dansal, the information seeker preferred first appeal dated 10.12.2013 before the Deputy Commissioner, Jammu which was disposed of vide order No.DCJ/Rdr/Subash/2014 dated 11.01.2013 with a direction to BDO, Dansal to provide the copy of specific resolution passed by the Panchayat Halqa, Nagrota in this regard to the information seeker. The appellant was also advised to approach to Director, Rural Development Department, Jammu.
The information seeker was not satisfied with the aforesaid order of the First Appellate Authority and preferred second appeal dated 04.04.2014 before the State Information Commission (SIC) wherein he alleged inter-alia that he has been provided incomplete information by the PIO/BDO,Dansal. The BDO, Dansal apprised the Commission vide office No.DBO/Dnl/2014-15/17 dated 24.04.2014 that the information was given to the appellant regarding Point No.1 vide office letter No. DBO/Dnl/2013-14/104 dated 02.12.2013. The PIO/BDO, Dansal further apprised the Commission that so far as Point Nos. 2 & 3 of the application is concerned, no clear information is available as sought by the applicant. Moreover, the applicant was requested to approach the office of the BDO, Dansal in order to clarify Point Nos. 2 and 3 of the RTI application.
During the course of proceedings at SIC the information seeker clarified Point Nos. 2 and 3 raised by him in the RTI application and BDO, Dansal agreed to furnish the requisite information especially the resolution of the Panchayat Halqa Nagrota which has subsequently been incorporated in the Panchayat Budget and was also published in the Govt. Gazette.
SIC order reads as :
" In view of the aforesaid facts and observations, the PIO/BDO, Dansal is hereby directed to furnish the requisite information to the information seeker free of cost within a week's time from the date of announcement of this order and send the same by registered post at the residential address of the applicant under an intimation to the Commission. |
