| BOPEE scam: HC issues notice on bail application by Peer | | | | Srinagar, June 13: A Division Bench of Jammu and Kashmir today issued a notice to government on bail application as well as revision petition filed by former chairman of Board of Professional Entrance Examinations (BOPEE), Mushtaq Ahmad Peer, who allegedly engineered the scam involving selling of Common Entrance Test papers before the scheduled examination in 2012. The division bench comprising of Chief Justice M M Kumar and Justice Hasnain Massodi issued the notice after hearing Peer's counsel, advocate Z A Qureshi. Peer has sought review of the order rejecting bail application by the Special Anti-corruption court here in Febuary this year. "The accused/petitioners have failed to carve out a strong case for bails in their favour, therefore the arguments rendered by counsel representing them being legally unsustainable, are repelled, rejected and discarded," Special Judge Anti-Corruption Kashmir, Mohan Lal Manhas had said while rejecting the bail application. The court held that the case is of great public importance and that the accused have murdered the merit of the meritorious students. Mushtaq Ahmad Peer was arrested on November 23 last year and has been booked in case FIR 24/2013 Under Section 420, 120B RPC, 5(2)d r/w (5(2) PC Act of Police Station Crime Branch. This was for the second time that the Court had rejected bail applications of Peer. |
