| Appointment of ReT teacher in Anantnag | | SIC issues penalty notice against ZEO Vailoo | | Early Times Report
Anantnag, Aug 12: As the Zonal Educational Officer of zone Vailoo in south Kashmir's Anantnag district failed to provide information about appointment of Rehbar e Taleem teacher appointment (ReT teacher) to an information seeker under State RTI Act, the State Information Commission (SIC) has issued a penalty notice against the erring ZEO asking him why he shouldn't be penalized for delaying the supply of information to the information seeker. As per details available with Early Times one Mushtaq Ahmad Bhat filed an application under RTI Act 2009 before Chief Education Officer (CEO) Anantnag on 29.03.2014 seeking information regarding order for advertisement of 3rd teacher ReT post in Middle School Gadvail by ZEO Vailoo without the approval of CEO Anantnag. He sought the Photostat copies of the whole panel of 3rd Teacher ie ReT post of M S Gadvail. This RTI application was transferred by CEO Anantnag to ZEO Vailoo on 04.04.2014 directing him to provide information to his office by or before 10th of April 2014 followed by reminder on 18.04.2014, 10.05.2014 and 09.06.2014. Finally, the information was submitted by ZEO Vailoo on 11.06.2014 to CEO Anantnag, who in turn sent the same to Mushtaq Ahmad Bhat vide letter dated 21.06.2014 enclosing the requisite information as sought by him. The information seeker had sought report of ZEO, Vailoo addressed to CEO office vide his No. ZEO/V/322 dated 11.06.2014 received by this office under receipt No. 2844 dated 12.06.2014, Photostat copy of advertisement notice published in newspaper through Department of Information under No. DIPJK-11519, Photostat copy of Marks sheet of Showkat Ahmad Bhat selected ReT, Photostat copy of panel for replacement of 3rd Teacher ReT in MS Gadvail, Photostat copy of Minutes of Meeting of Village Education Committee (VEC), Photostat copy of Advertisement by Directorate of School Education Kashmir published under No. DIPK-1843."
In response to the notice of the Commission (SIC) dated 21.07.2014, CEO Anantnag stated that the information dated 21.06.2014 was dispatched through registered post on 24.06.2014. However, instead of receiving the information, the applicant approached office of Additional Deputy Commissioner Anantnag. CEO Anantnag vide his letter dated 30.06.2014 has submitted that the information was sent to the information seeker through registered post but this was returned as per copy of the receipt enclosed. Subsequently the information seeker has received the information in the Commission's office on 14.07.2014.
SIC's order dated August 5th reads as:
"In view of the above it is evident that CEO Anantnag has transferred RTI application within prescribed time to ZEO Vailoo and has sent the information through prescribed mode of service to the information seeker. Therefore, CEO, Anantnag has acted in accordance with the RTI Act. However, prima-facie there is delay on the part of ZEO Vailoo who despite various reminders have failed to send information in time. Accordingly Sh. Hamid-ullah Malik, ZEO Vailoo is directed to explain as to why penalty proceedings shall not be initiated against him for delay in submitting the information. His explanation should reach the Commission within 2 weeks from issue of this order". |
