| Illegal possession of AK-47 Rifle Court acquits accused as prosecution miserably failed | | | Early Times Report
Jammu, Aug 18: (JNF) Principal Sessions Judge Poonch Jaffer Hussain Beigh acquitted Mohd Rashied S/O Abdul Ghani caste Gujjar R/O Hari Tehsil Surankote who was facing trial for the last 7 years in alleged illegal possession of a rusted AK 47 rifle, a rusted AK Magazine and 3 rounds of AK ammunition, as prosecution miserably failed. According to the police case, adjutant 45 RR lodged a report in Police Station Surankote with averments therein that on the receipt of specific information from source and NCCIU regarding the presence of arms in the house of the accused at Village Hari in Surankote. Two columns comprising of one officer and 19 RR from Jammushid Company of that Battalion led by Capt. Ashiq Hussain were launched on 11.9.2007 at 8 hours to the general area of Qureshi Mohalla Village Hari Tehsil Surankote. While conducing search of the house of the accused at about 14.20 hours on the said day, one column recovered a cache found hidden in wooden box duly wrapped in black clothes and war like stores AK 47 one rustic, AK Magazine one rustic and AK ammunition 3 rounds. On this, FIR No.133/07 for commission of offences u/Ss 7/25/26 Arms Act was registered in Police Station Surankote with which police swung into action and after completion of the investigation the said offences were established against the accused person and after completion of investigation presented challan. Principal Sessions Judge Poonch Mr. Jaffer Hussain Beigh after hearing both the sides and gone through the statements observed that t was Sepoy Bansi Singh who produced the ammunition to police which does not suggest that recovery was made from the house of the accused. With these observations Court said that prosecution has failed to prove its case and acquitted the accused from the charges leveled against him. |
