Court upholds imprisonment in CBI Case

jammu, Nov 24 (JNF): Principal Sessions Judge Jammu RS Jain today upheld the imprisonment of Sarfraz Choudhary and Sunil Kumar who looted the people in the name of job.
According to the CBI Case one Kramat Hussain Shah filed a written report/complaint to SSP CBI Jammu on 19.03.2007 averring therein that he is an unemployed youth and came to know that one person namely Sandeep Kumar who is working in MES Udhampur is collecting money worth Rs. One lac from each candidate for arranging their employment. During the investigation, in order to find genuineness of complaint the conversation between Sandeep Kumar and Kramat Hussain (complainant) which took place on the mobile No. 9419410524 of Sandeep Kumar with mobile No. 9419726872 of Kramat Hussain Shah was recorded from time to time between 19.03.2007 till 23.03.2007. The said record conversation has been saved on compact discs through computer and was confirmed by complainant. The conversation also reveals that Sandeep Kumar has already taken Rs. One lac from few other candidates (approximately 200 to 300 candidates as revealed by Sandeep Kumar himself in the conversation) for arranging job in MES and the accused has also demanded Rs. one lac for arranging job to the complainant in MES. The suspect/accused Sandeep Kumar showed his inability to reach Jammu due to busy schedule and the meeting was fixed for 23.03.2007 at 10 P.M. at Jewel Bar Jammu for paying bribe amount. The enquiry was also made secretly and it was learnt that Sandeep Kumar is working as JE in MES Udhampur but not as PA. On the basis of complaint and enquiry report, the investigating team laid a successful trap at Jewel Bar in which two appellants were caught red handed while demanding and accepting a bribe amount of Rs.20,000/- from complaint. The accused made disclosure and on their identification their accomplice namely Anwar Hussain was also apprehended on the same day and Anwar Hussain during their interrogation in presence of independent witnesses disclosed that they have collected money from various candidates with the false promise of providing them job in MES. The name and details of those persons were shown in confrontation/disclosure memo which was duly got signed by the witnesses in presence of all concerned. After completion of the investigation challan was presented and CJM Jammu has awarded one year imprisonment against that conviction present appeal was filed.
Principal Sessions Judge Jammu RS Jain after hearing both the sides observed that this Court finds no reason to intervene in the impugned judgment of Trial Court in so far as finding the appellants Sarfraz Chaudhary and Sunil Kumar guilty. The finding reached by the trial court after appreciating the evidence on record in holding the appellants guilty of offence u/s 419/420 RPC cannot be faulted with. For the aforementioned reasons, this appeal is without any merit and is dismissed. The order of holding the appellant guilty of offence u/s 419/420 RPC recorded by the trial court is upheld.
